S.B. No. 1868
1 Sec. 8471.004. CONSENT OF MUNICIPALITY REQUIRED. The
2 temporary directors may not hold an election under Section 8471.003
3 until each municipality in whose corporate limits or
4 extraterritorial jurisdiction the district is located has
5 consented by ordinance or resolution to the creation of the
6 district and to the inclusion of land in the district.
7 Sec. 8471.005. LEGISLATIVE FINDINGS OF PUBLIC PURPOSE AND
8 BENEFIT. (a) The district is created to serve a public purpose and
9 benefit.
10 (b) The creation of the district is essential to accomplish
11 the purposes of:
12 (1) a municipal utility district as provided by
13 general law and Section 59, Article XVI, Texas Constitution;
14 (2) Section 52, Article III, Texas Constitution, that
15 relate to the construction, acquisition, improvement, operation,
16 or maintenance of macadamized, graveled, or paved roads, or
17 improvements, including storm drainage, in aid of those roads; and
18 (3) Section 52-a, Article III, Texas Constitution,
19 that relate to the development and diversification of the economy
20 of this state.
21 (c) The creation of the district is necessary to develop,
22 encourage, and maintain safety and the public welfare in the
23 district.
24 (d) All land and other property in the district will benefit
25 from the improvements and services to be provided by the district
26 under this chapter.
