MONTAGUE - With
little choice other than
picking up the tab them-
selves, the Montague
County Commissioner's
Court voted Monday to
have County Judge
Tommie Sappington to
sign a letter freeing the
Texas Department of
Transportation to close a
rest area on U.S. Hwy. 81
between Ringgold and
Stoneburg.
TxDOT announced last
year that it would, as a cost
saving measure, close liter-
ally hundreds of the small
rest areas across the state.
Previous announcements
from the Wichita Falls
TxDOT office stated it cost
approximately $10,000 a
year to maintain the site
located in a scenic area
alongside a tributary to
Belknap Creek.
Shane Watkins of
Bowie represented TxDOT
at the meeting.
Judge Sappington asked
what TxDOT's response
was to a request from the
Montague County
Historical Commission to
relocate the "Highway
Paved with Gold" histori-
cal marker, currently locat-
ed at the rest stop, and the
large stones with hand
carved messages.
Watkins said the
Historical Commission had
mentioned relocating the
historical marker to one of
two locations - either next
to an already existing his-
torical marker on U.S.
Hwy. 81 at RC Road or
next to an already existing
marker on U.S. hwy. 82
just east of Ringgold.
"You will see that the
sign is moved?" Judge
Sappington inquired.
Watkins was asked what
would be done with the
property. He said if the
land had been donated, and
he thought it had, it would
revert back to the adjoining
property owner. If not, then
TxDOT would retain the
rights to it.
In other business, the
court approved the racial
profiling report form
Precinct 2 Constable
Herman Conway, who was
not in attendance Monday
morning.
It also approved
requests to follow the
Texas Transportation Code
to close 450 feet of Fox
Run Road in precinct 2 and
a portion of Northwood

named in felony indictment
MONTAGUE - When
the District Attorney's
Office released the names of
people indicted Feb. 13th to
the area news media it
misidentified one of the
defendants.
The felony indictment for
criminal mischief, more than
$1,500 but less than
$20,000, listed "Elvin Ray
Glenn, 53, of N ocona" was a
defendant when in fact it was
his son, Elvin Ray Glenn, Jr.,
30, who was charged with
shooting up a tractor belong-
ing to Tom Skinner in the
summer of 2010.
"It was my son they
charged," Elvin Glenn Sr.
told The Nocona News while
asking that the identification
be clarified.
"I don't think our reports
showed it, but I think he's
actually a junior," District
Attorney Jack McGaughey
said of the defendant.

Accused of causing his
girl friend to miscarry their
5-monh-old fetus, by slam-
ming her stomach repeatedly
with a car door, Michael
Cunningham, 30, of Nocona
has been charged with mur-
der.
There is a chance, said
District Attorney Jack
McGaughey, that the
charges may be upgraded at
a future date to capital mur-
der.
"Initially, it was a med-
ical call. But when the para-
medics got there and figured
out what happened it was
'Whoa!'" described Sheriff
Paul Cunningham, who is
not related to the suspect,
explaining how his officers
became involved in the
investigation.
"Ms. Quintana being 5
months pregnant was bleed-
ing heavily and had dis-
charged large amounts of
blood prior to EMS arrival,"
Deputy Sheriff Dale Ingram
said in his affidavit seeking a
warrant to charge
Cunningham with murder.
After Mrs. Quintana was
transported to Nocona
General Hospital, Chief
Deputy J.T. Mitchell went to
the hospital where he
obtained her statement.
"Ms. Quintana stated that
(at) approximately 6:00 p.m.
Feb. 23 she and the defen-
dant left Oak Shores and
drove into Nocona to get
pizza and beer, and the
whole time the defendant
was trying to argue with her.
When Ms. Quintana told the
defendant she was not going
to argue, he became more
agitated," Dep. Sheriff Dale
Ingram alleged in the affi-
davit. "Ms. Quintana stated
she was five months preg-
nant and that Defendant was
the father of her child.
"Ms. Quintana stated
when they returned to 347

Pine Rd. she got out of the
car to retrieve the beer and
pizza from the rear seat, and
the defendant grabbed her
from behind by her pony tail
and spun her around facing
him, at that point the defen-
dant raiser a closed fist as if
to strike her. Ms. Quintana
then stated that the defendant
slammed the rear door of the
car into her stomach twice
causing her severe pain in
her stomach and chest.
"She (Quintana) stated
the assault immediately
caused her to feel like she
needed to urinate, and it also
made her feel like she need-
ed to push something out,"
the affidavit continued.
"Ms. Quintana stated she
went into the house at 347
Pine Rd. and went into the
bathroom, and at that point
she stated she sat on the toi-
let, and felt something com-
ing out, and there was a lot
of blood. At that point the
victim's mom called 911
Medical Assistance."
"Affiant learned that
based on the examination
conducted by ER P.A. Bret
Meredith at Nocona General
Hospital, trauma was present
in the placenta which could
have been caused by the vic-
tim's stomach being struck.
"Affiant learned from
medical attendants at North
Texas Medical Center of
Gainesville, Texas, who
were attending to Ms.
Quintana, that at
mately 1:54 a.m.
2011, fetal
occurred."
On Friday, Feb. 24,
Deputy Ingram secured the
felony murder warrant from
Justice of the Peace David
Allen.
As deputies arrived at the
residence in Oak Shores,
Michael Cunningham fled in
a vehicle. He was later spot-
ted, and after a brief chase
was apprehended about
Michael Cunningham
11:10 p.m. He was initially
charged with driving while
intoxicated and evading
arrest or detention with a
vehicle with previous con-
viction, a felony.
"There's a possibility it
could be upgraded,"
McGaughey said Tuesday
morning. "It's too early to
make that decision. We have
to wait until all the reports
are in. But we're comfort-
able with it being filed as
murder at this point."
Nocona Police Chief
Kent Holcomb stated his
office was evaluating
whether to file charges
against Michael
Cunningham for attempted
aggravated assault of a peace
officer. "He tried to run Matt
down," Chief Holcomb said
of Sgt. Matt Poole, who had
responded to the scene in
Oak Shores to assist sheriffs
deputies.

the defendant's name to dif-
ferentiate him from his
father.
But as for how his office
picked up the wrong age of
the defendant, McGaughey's
brief answer was, "I really
don't know."
