of February 1916 then and there-
to answer plaintiffs petition fil-
ed In said court on the 26th day
of November 1945 In this cause
numbered 2512 on the docket of
said court and styled Trank J
Shaller plaintiff vs all those
persons first named In this writ
and to whom the same Is direct-
ed defendants
A brief statement of the nature
of this suit Is as follows towlt
Tills action is brought as well
to try title as for damages and
involves a certain tract of land
situated in Hemphill County
Texas described as follows
A part of the James Calk sur-
vey Abstract No 29 describ-
ed by metes and bounds as
follows
Beginning at the Northeast
corner of Section 4 GH1I RR
Co Thence north 2312 5 var
as Thence cast 950 varas
Thence north 950 varas
Thence cast 950 varas
Thence south 3292 5 varas to
the Northeast corner of Sur-
vey No 1 GHH RR Co and
the southeast corner of the
James Calk survey Thence
west 1900 varas to the place of
beginning and containing
917 62 acres more or less
Plaintiff alleges that on the
1st day of October 19 5 he was
and still Is the owner In fee sim-
ple of said premises that after-
ward on the 3rd day of October
1945 the defendants unlawfully
dispossessed him of such prem-
ises and unlawfully withhold
from him he possession there-
of to plaintiffs damage In the
sum of TOUR HUNDRED DOLL-
ARS 400 00 Plaintiff further
alleges In the alternative that
he holds title to the above de-
scribed land omder and by vir-
tue of the Three Year Five Year
Ten Year and Twentyfive Year
Statute of Limitations and un-
der and by virtue of the provi-
sions of Article 5519 a of the Re-
vised Civil Statutes of the State
of Texas Plaintiff sues for judg-
ment for the title and possession
of said above described premi-
ses for his damages for cost of
suit and for such other and fur-
ther relief In law or in equity
to which he may show himself
Justly entitled
If this citation Is not served
within ninety days from the
date of Issuance it shall be re-
turned unserved
The officer executing this pro-
cess shaU promptly execute the
same according to law and
