Contempt for court?
T*HE TExaS SUPREME COURT has never
1 been one of the most distinguished of the
nation’s tribunals, and has had a few members
who were "distinguished” mostly by their lack of
that quality...notable among them not many years
ago was the "other Don Yarbrough” who won
election as a Justice of that Court just in time to
face justice of his own in a lower court.
The State’s High Court currently has a pair of
sitting Justices who are facing demands for
resignation and possibly impeachment. Justices
C.L. Ray and William Kilgarlin have both been
publicly reprimanded for seven counts of mis-
conduct by the State Commission on Judicial
Conduct...the legal system’s own reluctant watch-
dog. It requires some powerful incentive to make
that one bark.
Both Governor Clements and Senator Frank
Tejeda, chairman last year of the House panel
which investigated the alleged wrong-doings of the
two Justices, have called for their resignations.
Both have refused, Kilgarlin calling the Findings of
of the investigators "a crock of manure ’...a
rejoinder which may reflect too accurately the
dignity of that court.
Whether the Legislature will undertake an
impeachment proceeding remains to be seen.
Legislators have troubles of their own at the
moment, with their Governor holding their feet to
the fire to produce a workable budget...and
Governor Clements has his mind on that weighty
subject, but might call a special session for
impeachment later when the budget problem is
settled. Somebody should.
Ray and Kilgarlin were reprimanded for such
trivial pursuits as accepting free plane rides, trying
to transfer court costs for a campaign contributor,
soliciting funds from attorneys with cases before
their court, and pursuing a libel action against a
witness who testified against them at the
legislative inquiry. Kilgarlin was hit with a "public
admonition" for seeking funds for the libel suit,
and both were admonished for improperly in-
structing two attorneys on the Code of Judicial
Conduct.
That last one may have been a low blow, since
both of the High Court justices obviously haven't
much comprehension of the Code of Judicial
Conduct. But they should have, and the Court
which carries the weighty title of "Supreme Court
of Texas” ought to command more respect than
this from its own members.
