Higgins is defendant, said peti-
tion alleging in subst'ince that:
On November 4, 1027, plaintiff nnd
defendant were lawfully married
to each other In the City of Clo-
vis, State of New Mexico, and
continuously resided together at
the plnlntlff's home alsxit ten miles
northwest of Hereford, hi Donf
Smith County, Texas, until on or
about the Ulli duy of February,
1021), at which time the defendant,
without any cause or justification
j on the |«rt of plaintiff, abandoned
land left plaintiff, and since said
I time plaintiff and the defendant
j have not lived together as husband
and wife
That, for i is-rhxl of aland six
months after said marriage plain-
tiff and the defendant lived hap-
pily together, or apparantly so, on
the part of the defendant; hut
that after the plaintiff and the
defendant had been married for
about six months, tin* defendant,
wholly disregarding the solemnity
of her marriage vow to treat
plaintiff with kindness and atten-
tion, although pfalntlff was ever
kind and dutiful toward her as her
husband, provided for her In koeie
ing with plaintiff's financial abili-
ty, nnd the social status of plain-
tiff mil the defendant, the defend-
ant commenced and followed a
course of unkind, harsh and cruel
tyrannical treatment and conduct
toward plaintiff, anil constantly
oentinued said treatment and con-
duct until the same became un-
bearable with plaintiff, and until
the defendant finally, as above al
leged, without any cause on plain-
tiff’s part, abandoned and left
plaintiff.
That, after plaintiff and the de-
fendant had been ao married for
said period of about six months the
defendant commenced to, and con-
tinuously during the time she and
plaintiff lived together, thereafter,
nag at and abuse plaintiff by ap-
plying lo plaintiff opprohloua and
vile epithets nnd names and threats
of personal violence, and accusing
and charging plaintiff with dta-
honest, often and repeatedly call-
ing pluintlff many vile unmea, all
without any provocation or justifi-
cation. lull with kindness, fore
henrnnee nnd indulgence on plain-
tiff's |sirt, plaintiff being at all
linn** mindful of his conjugal dutiee
toward defendant, alwtiys kind to
her, arid in indulgent and consul
erate of her, ns was humanly pos-
sible under such circumstances
That during said time Plaintiff
was lii a bad state of health, from1
which he has not fully recovered,
and the said abusive conduct of
the defendant toward him was not
conducive to tile Improvement of
his said health but that owing to
the natural condition of his said
health, as well aa bis finer aenai-
bill ties and nature, aucb conduct

make their living together insup-
portable.
