Associated Presi Report.
CHICAGO. Nov. 17 Tsl of th

(States supreme court by action In the
Pedernl district court here.
Judge George A. Carpenter denied
the bill for an Injunction filed by Ok-
Chicago boa rd of trade but con tin -tied
in force for a stay order prevent-
ing enforcement of the law. and then
granted the board an appeal to the
suprv me court. This the court ei -plained
would be the shortcut method
of reaching an adjustment of the con -stltutmnalily
of the act.
Judge Carpenter also denied a pe-
tition of the American Farmer Bu-
ivau Federation to IrHevene tn th
suit explaining that whiU- the gov-
ernment would welcome any assistant
of the federation he saw no imiHirtnnl

Judge Carpenter iu dismissing the
board's bill said.
"This case is so far reaching th.it
it must eventually go to the supreme
court. If it wss tried here judging
from the statements of counsel there
would be no end of testimony and
the shorter course seems to be p re-

Permission of appeal was granted
with the concurrence of government
counsel.
Denies Petition.
Judge Carpenter besides denying the
board bill of an injunction also denied
petition of the American Farm Bu-
reau Federation to- intervene as co-
defendant with the government.
After listening to brief review of
the present laws aa well as one held
unconstitutional by the supreme
court Judge Carpenter In denying the
bill explained that such a course was
followed in the interest of all the
parties affected. This he said was
the shortest course to obtain final
decision on the constitutional it y of
the law.
In denying the application of the
American Farm Bureau federation
the court said there seemed to Le no
important reason why the federation
should be allowed to intervene al-
though the court would not be averse
to hearing the federation's represen-
tatives and that the government would
welcome any substitution of the gov-
ernment's case by the federation.
Nevertheless. Judge Carpenter said
he saw no reason why the federation
should be made a co-defendant.
