Three minutes were long enough for 12
jurors In the criminal district court to
convince Clarence Cooley. confessed mur-
derer that Friday was his unlucky day.
His own confession was all that was
necessary to send Cooley to the gallows.
The ' other evidence was too much of a
circumstantial nature. Bnd had he not
admitted the crime It Is probable that he
would not have drawn the death penalty.
Without batting an eyelash and with-
out a tremor of fear the doomed man re-
ceived the verdict that was to snuff out
his life like a candle. Not so with his
relatives and friends however. As the
foreman of the Jury read the words the
full meaning of which could not be mis-
taken a groan of horror went up from
the colored side of the house.
TRIED FOR ONLY
ONE MURDER.
Cooley was tried upon but one charge
that of the killing of Johanne Hansen
of near Aldine although he confessed to
the murder of two other white men. It
was understood that had not the Jury
assessed capital punishment n this case
District Attorney Crooker Intended to try
the two other murder charges against
Cooley.

Cooley had brought to her house property
later Identified as belonging to Anderson
and Hansen. Her daughter little Moselle
Evans then took the stand.
"How old are you. Moselle ?" asked At-
torney Heldingsfelder.
"Seben suh." replied the little girl in
a faltering voice.
"When were you born?" questioned the
attorney.
"In 1905 please suh."
"Don't you know that If you were bom
In 1905 you would be older than seven?"

"Man mammy says I'se seben an Ah
reckons she knows" responded the wee
darky with perfect confidence. She was
dismissed.
Next came the official testimony of the
county officers who told of the arrest of
Cooley and others suspected of the crime
the accumulation of evidence and Anally
of the negro's confession.
T. J. Harris assistant district attorney
testified that no promises had been made
to nor no threats against Cooley to ob-
tain his confession. Furthermore Mr.
Harris said and Sheriff Hammond sub-
stantiated his statement that the con-
fession was taken down verbatim on the
typewriter. He then read the document
to the Jury.
Step by step and detail by detail all

quence the negro told the story of his
crime. When he related in his confes-
sion how he had shot down in cold blood
the two white men who iiad done him 140
injury and how. afterwards he had
searched the pockets of his victims for
money ithere was much suppressed feel-
ing evident among the spectators.

men." said Mr. Crooker "yours Is a
solemn responsibility. You are here as
the representatives of society In general
and the cltlxens of Harris county In par-
ticular. You are in a unique position.
Other courts and higher tribunals may
rectify the mistakes that we lawyers may
make but your decision In this case will
be final."
"There is not a reasonable doubt that
the prisoner committed the crime of
which he is charged. He has both plead-
ed guilty and signed a full and complete
confession. The crime is one.of the most
morbid and revolting ever committed In
this county. It was the work of an arch
fiend.
DOESN'T OFTEN ASK
FOR DEATH PENALTY.
"It is not o(ten that I ask a Jury to In-
flict a death penalty but this I consider
an exceptional case. There are absolute-
ly no mitigating circumstances. Cooley
weighed so many pieces of silver against
so many drops of blood. No more cold
blooded heartless case could be put be-
fore a Jury."
Judge Crooker also pointed out to the
Jury the fact that under the laws of Tex-
as they could not sentence a man to a
definite number of years in the peniten-
tiary. Under the indeterminate sentence
plan a convict ran reduce his sentence
and he is always subject to pardon.
In defense of the negro Attorney .
Heldingsfelder made a 10 minute talk. He
explained to the Jury that he had been
appointed by the court to act for the
prisoner and would receive no compensa-
tion for his services. He made a strong
plea for life imprisonment.
"Don't take that which you can not
give." said Mr. Heldinpsfelder. "This
man made a full confession and by so
doing vindicated others under suspicion.
He was led to make this confession by
officers of the county under the Im-
pression that tt would help his chances."

The well brought In by the American
Petroleum Corporation of Chicago at
Goose Creek which was temporarily
choked up with sand Wednesday was
opened up again Friday and is reported
flowing steadily.
Charles Mitchell vice president and
manager of the company stated Friday
that the well is flowing over the top of
the 90-foot derrick and that it filled a
600-barrel tank In 25 minutes. He esti-
mated the flow at 115000 barrels dally
and said that the pipe line has been run-
ning day and night since the opening of
the well and has not been able to iarry
away the oil.
A storage tank with 100000-barrel ca-
pacity has been erected nrt mlriitlrni
tanks are being put up. Tho company Is
also starting to drill six new wells In the
uoose reea nein. j. tl. Christian presi-
dent and L. A. Rockwell treasurer of the
company arrived in Houston Friday and
will visit the well Saturday.
