She seeks to avoid testifying for man who shot gay ‘secret admirer’ after taping

DETROIT — Jenny Jones will ask a
judge to release her from testifying at
the trial of a man charged with murder-
ing a gay "secret admirer" three days
after she brought them together for a
taping of her talk show.
Jones' request to dismiss a subpoena
requiring her to testify is set to be
argued at a hearing Nov. 29 in Oakland
County Circuit Court in the Detroit
suburb of Pontiac.
The defense wants Jones to testify at
the trial of Jonathan T. Schmitz of Lake
Orion, who is charged with first-degree
murder in the shotgun slaying of Scott
Amedure on March 9. Amedure had
revealed his crush on Schmitz during a
secret admirers segment of The Jenny
Jones Show in Chicago.
The segment was never broadcast.
Schmitz's attorneys have said he is
heterosexual and was humiliated by
Amedure's public revelation and subse-
quent advances, including a sexually
suggestive note left on his apartment
door. The two were acquaintances
before the show.
"Jones is crucial to our defense,"
attorney Fred Gibson said Wednesday.
"The court will make a decision that she
is or isn't."
Telepictures Productions, which
owns the syndicated talk show, will
contest the Jones subpoena, attorney J.
Michael Huget said.
"She should not be required to come
to Michigan to testify, for the reason
that the extent of her encounter with
Schmitz or Amedure was recorded on
videotape, which the defendants have,"
Huget said.
"You have the tape, you have the
extent of her contact. That's the best evi-
dence of what she knows."
Jones has denied the show was
responsible for the slaying.
Huget said Telepictures will not
oppose subpoenas issued for the two
producers who handled the segment,
Karen Lautens and Ron Muciante.
"They did have contact with them
before. The producers were the people
responsible for interviewing the guests
and arranging with them for their
appearance on the show."
In another development, a judge
ruled that only one of several incrimi-
nating statements Schmitz gave to
police will be allowed as evidence at
trial.
Schmitz’s initial statement to a
policeman that "I just shot somebody"
is inadmissible because it came before
he was advised of his rights, Circuit
Judge Francis O'Brien ruled.
The confession came shortly after
Schmitz, 25, called police from a service
station pay phone to turn himself in
minutes after Amedure, 32, was killed
in his Lake Orion mobile home.
. O'Brien, in his ruling dated Nov. 9
and released Wednesday, also withheld
statements Schmitz made to the officer
on the way to the Auburn Hills police
station.
The judge said a statement Schmitz
gave after he was read his rights at the
station will be allowed, but that the trial
jury will have to decide if it was made
voluntarily.
Trial is scheduled for early January;
an exact date has not been set.
Schmitz's attorneys argued during
pretrial hearings that Schmitz could not
have given that statement voluntarily
because he was distraught and inca-
pable of making a rational decision to
waive his rights.
O'Brien, however, noted that police
testified Schmitz appeared coherent,
that he signed a waiver acknowledging
he understood his rights, and that he
did not ask for an attorney.
A confession Schmitz made in his 911
call also will be allowed as evidence.
His attorneys did not dispute its admis-
sibility. T
