“Concealed”
“That guy is so tough,” runs an old
gag, “that if he puts his hands in his
pockets, he could be arrested for car-
rying concealed. weapons.”
He couldnT, though, no matter how
deadly his fišťs, because they would
not be “concealed.” In špite of the
fabric eovering. the pockets, anyone
could telí that his hands were there.
For contřast, consider this ease:
A -man arrested with a gun in his
pocket argued that it had not really
been concealed, because it made a dis-
tihct and y.isible bulge, \ "
But tlié' court decided there was
still sufficient concealment to make
the man guilty of the charge. The
judge said a mere bulge was not
enough warning, to an ordinary ob-
server, that the man was armed.
It is this test — obviousness to an
ordinary obseryer — that the law usu-
ally applies in deciding whether a
person is earrying a concealed weapon.
Thus, a gun would not be eonsidered
concealed simplý because a particular
person, looking from a particular
angle, was unable to see it. For ex-
ampie:
A man who had a gun openly dis-
played in his holt was found not guilty
of the offense. Elven though the ar-
rešting officer — approaching from
behind —- could not see the gun,
it was obvious enough for ordinary
observation.
And what does “earrying” mean?
Does the person actually háve to be
moving with the gun?
One man, seeing an officer near by,
hustily slipped his pistol into an in-
sicle pocket. Arrested and brought to
trial for earrying a concealed weapon,
he offered this defense to the court:
“ ‘Carrying’ means transporting the
weapon from one plače to another. I
did not move a single step.”
But the court pointed out that, al-
though “carrying” could mean “trans-
porting,” it could also mean just “pos-
sessing.” The judge decided to piek the
meaning which, considering the pur-
pose of the law, made the most sense—

and he found the man guilty.

§91,980 FEDERAL GRANT APPROVED
FOR, McKINNEY PARKS
A $91,980 Federal grant has been ap-
proved for construction of outdoor re-
creation íacilities in three city parks
wihtin the boundaries of the north
Texas city of McKinney, according to
Will Odom, chairman of the Texas
Parks and Wildlife Commission.
These íunds will be matched by city
funds in a $183,960 projed, to develop
approximately 80 acres of the total 260
aeres in Finch, Mouzon and North City
Parks, Odom said.
Plans for development include con-
s.truction of roads, footbridges, park-
ing areas, restrooin and concession
buiidings, Service and storage buildings,
plenic units, playground equipment.
The projcet also includes design, lay-
out, sile preparation,, landscaping and
íencing.
Odom said the McKinney project
marks tlie 22nd city, county or river
authority park which has received
funds since the Land and. Water Con-
servation Fund Aet was passed by the
U. S. Congress in 1965.
Odom said the originál proposal for
the project was submitted by Mayor
W. B. Finney and City Manager b. J.
Cope of McKinney.
Tito Federal Land and Water Con-
servation Fund Program, which pro-
vides the Federal funds, is administer-
cd on the Federal level by the Bureau
of Outdoor Recrcation, U. S. Depart-
ment of Interior. Its funds are derlved
from the sále of surplus government
property, Federal motorboat fuef tax
and the sále of the $7 Golden Eagle
Fassport and other outdoor reereation
fees.
Odom is State Liasion Officer for the
fund and responsiblc for reviewing pro-
jeets and proposals submitted for Fed-
eral assistance.
