Only six entrances
into the city are not
eligible to be blocked off
because they do not
have residential pro-
perty fronting them:
College Street at Bis-
sonnet, Stella Link Road
at Bellaire, Fairhaveti
Street at Bellaire,
Auden at University,
F.dloe Street at Univers-
ity and Fairmont Street
at Law.
However, even the 55
streets that are eligible
to be blocked off cannot
be barricaded if less
than 80 percent of the
‘‘affected property
owners” in a street
closing proposal do not
consent to the barricade
or the city's staff or City
Council determines that
the street proposed for
closing does not have
‘‘extraordinary vehicu-
lar traffic problems
which cannot be elimi-
nated in any other
reasonable manner,”
the proposal states.
In addition, council's
decision to close a street
will depend on the effect
of the closing on circula-
tion of traffic within the
residential area af-
fected, the effect on the
general circulation of
traffic in the city as a
whole and the effect on
the access of emergency
vehicles, garbage trucks
and other city vehicles,
the proposal states.
The proposal ap-
proved Monday night
was an expanded
version of a recom-
mended proposal sub-
mitted to council by the
city’s Traffic Committee
last summer.
The Traffic Com-
mittee’s proposal would
have limited street clos-
ings to only those streets
that have residential
property fronting them
in the first block off a
major thoroughfare that
borders the city. Under
that proposal, only 46 of
the 61 entrances into the
city would have been
eligible to be blocked
off.
Forristall said she ex-
panded the proposal to
give more city residents
the option to petition
council to have their
streets closed off. She
said the final decision
whether or not to close
any particular street still
lies with council.
“It comes back to
council making the
decision,” the mayor
explained. “These are
just guidelines.”
The mayor decided to
refer the document to
City Attorney Allums
after Counciimen Jack-
son and Weatherly
raised questions about
the legality of the
document.
“Is it legal to close
streets that have been
dedicated as public
rights-of-way?” asked
Weatherly.
Allums told The
Texan last November
that state law gives
Texas cities the power to
do whatever they want
with streets inside their
city iimits, including
closing them.
