New York, April 30.—Before an
demblage of lawyers which comprised
almost every justice of the supreme
court, every justice of the appellate
division, every justice of the federal
circuit courts sitting in or near New
York and practically every prominent
personality in legal Circles, Attorney
General Wickersham today outlined
his program concerning the adminis-
tration in general and the exercises of
the Sherman anti-trust act in particu-
lar.
William Nelson Cromwell, Senator
Chauncey M .Depew, William B. Horn-
blower, Martin W. Littleton, John F.
Milburn, Alton B. Parker, Jon Stanch-
fteld, Edwin M. Sheppard, Henry W.
Taft, B. F. Tracey, Samuel Untermey-
er, and a score of other equally noted
lawyers joined in the tribute paid the
new attorney general by the members
of the fear in this city.
Most notable among those who eu-
logized the guest of the evening were
J r Si pli H. Choate, Judge Gray of Del-
aware, Justice Patterson, Judge Ward
and Deiancey Nicoll. Mr. Choate, in
bait' tender, half humorous vein, trac-
ed the career of Mi. Wickersham. “Mr.
Wicaersham.” said he, “has courage,
charaetter and unbounded loyalty to
hjs profession. His profession will re-
spond by thorough loyalty to him.”
Mr. Choate ended by congratulating
Mr. Wlcki rsham upon the opportuni-
ties the office of attorney general
placed in bis hands.
* “It will be his great privilege,” said
he. “to be restorer of the constitution
of the United States; to prove once
more that ours is a government of
laws anti not of man. It will be bis !
4uty to Bee that no offense is big
enough and no corporation is criminal
enough to justify the imposition df a
fine of $043,525,267.23.” 1
Speaking of the laws which lit will
be his duty to enforce, Mr. Wdcker-
sham said: '
"Perhaps in this connection it may
be appropriate to state in a few words
my ideas of the proper attitude of the
department of justice ‘with respect to
the enforcement of laws affecting the
business interests of the country. You
all know that the attitude of a very
large part of the business community
toward some of the laws enacted by
congress was, prior to six or seven
years ago. one of indifference when
not of hostility. There was a prevail-
ing Impression that many of the laws
dealing with economic subjects had
been passed to oe pointed to with pride
rather than to be enforced. Then there
came a rude awakening. The last ad-
ministration set to work with vigor,
with energy, which was accompanied
at times by newspaper clamor, to en-
force the laws. Business men who had
not read the Sherman anti-trust law
today know it by heart and railroad
men and shippers alike have an inti-
mate personal acquaintance with the
interstate commerce act.
“We have consequently heard of late
reports of certain business interests of
the country crying, ‘Let us have
Peace* and ‘Let us alone.* The price of
peace la obedience to law; those who
honestlly try to keep within the law
Heed not fear prosecution. I am per-
fectly well aware that there is an un-
certainty as to the precise scope and
meaning of the law which must close-
ly touch all business activity of the
country, namely, the Sherman anti-
trust law, and I should be the last to
authorize the institution of a criminal
proceeding against men who, without
intent to break, have nevertheless act-
ed in technical contrast of that enact-
ment.

that law agreed upon by all the higher
courts, to combine in the form of a
trust, or otherwise, with the obvious
intention of restraining commerce
among thp states or of creating a mo
nopoly of an important part of that
commerce, would evidence such de-
liberate intention to break the law as
to justify and compel the government
to use all or any of the remedies giv
en by law adequate to prevent the ac-
complishment of.such purpose and
punish the attempt.”
