THE POLK COUNTY ENTERPRISE
Voters' rights intact

Texas Secretary of State
The U.S. Senate is debating the
passage of a bill (S. 565) to re-
form election laws and proce-
dures throughout our nation.
These changes are intended to
ensure that the problems that
occurred in the 2000 presidential
election are not repeated.
As currently proposed, S. 565
would require states to adopt
procedures to allow voters an
opportunity to receive a new bal-
lot in the event they make a mis-
take on their first one, or to vote
provisional ballots if their names
do not appear on the list of regis-
tered voters. Each state would
also have to maintain a comput-
erized list of registered voters,
and all newly-purchased voting
systems would have to be acces-
sible to voters with disabilities.
In Texas, our election laws al-
ready require all of these things,
but, unfortunately, not every
voter is aware of that fact.
In an effort to inform voters of
the Texas election laws and
procedures that are already in
place gild to assure each voter's
abilltjr to cue a ballot that will
be counted, I'd like to review the
rights that Texas voters are guar-
anteed under state law.
* Voters have the right to ask
election workers for instructions
on casting a ballot and the right
to receive assistance if they can-
not read or mark the ballot.
* Voters who do not speak the
same language as the election
officials have the right to bring
an interpreter to assist them in
communicating with those elec-
tion officials.
* Voters are entitled to bring
written materials, such as sample
ballots, into the voting booth to
assist them as they cast their bal-
lots.
* Voters have the right to re-
ceive up to two more ballots if
they make a mistake while mark-
ing their first ballot.
* Voters have the right to be
informed of the possibility to cast
a ballot if their eligibility to vote
is questioned. For example, when
a voter arrives at the polling
place, the election judge will ask
for a voter registration card or
some other form of identifica-
tion. The judge then looks up the
voter on the list of registered
voters and does not find the
voter’s name on the list. The
election judge should then at-
tempt to contact the voter Regis-
trar for registration confirmation.
If the voter registrar has no re-
cord of registration, the election
judge shall inform the voter
about the challenge procedure.
Under this procedure, the elec-
tion judge must give the voter an
opportunity to swear on an affi-
davit that the voter registered to
vote at least 30 days before the
election and meets all other re-
quirements to vote. Once the
voter has completed the affidavit
showing that the voter has Regis-
tered and met the registration
requirements, as well as pre-
sented a valid form of identifica-
tion, the judge must let the voter
vote.

right to vote in secret and free of
intimidation.
