What if you receive something
in the mail that you did not dider?
Mail order con artists sometimes
send an item, along with a phony
invoice, hoping that you vdll be
fooled into paying for something
that you did not order. In most
you may consider it a gift.
While there are exceptions, such as
agreements you might have with a
book or record club, the general
rule is: if you didn't order it, you
don’t have to pay for it. **-«

CATALOG AND
MAIL ORDER SALES
t | lHE HOLIDAY SEASON is
I the busiest time for shop-
ping in Texas. Many of us
are pressed for time and welcome
the convenience of shopping by
telephone or mail. The rewards are
many, but there are a few risks as
well.
The overwhelming majority of
mail and phone order businesses
are legitimate, but there are seme
unscrupulous marketers out there
who are willing to take your money
and send you nothing.
That is why we at the Office of
the Attorney General havojmt to* .
gether a few tips to help you avoid..
becoming a victim. Remember; ,
when you shop by mail or phone,
you are protected by federal and
state laws.
Fair Credit Billing Act
The Federal Trade Commis-
sion (FTC) is charged with protect-
ing consumers who shop by mail.
Under the federal Mail Order Rule,
vendors must ship ordered mer-
chandise within the advertised time
period. If no specific shipment date
or delivery time is promised, the
seller must send your merchandise
no later than 30 days after receiv-
ing your order. For consumers
paying by credit card, delivery
must occur within 30 days after the
account is charged.
Know your rights
If the sellers are unable to fill
your order within 30 days, they
must send you an option notice.
The notice must tell you the new
shipping date and inform you of
your right to cancel and request a
full 'refund. If you choose to cancel
your order, the seller must mail
your refund within seven working
days. If you bought on credit, the
seller must adjust your account
within one billing cyde.
