in the county of Pecos, if there be a
newspaper published therein, but if not,

has title to said tract of land and has
derained and derived his title as follows,

to the plaintiff from D. S. Barker,

tiff has had the land entirely surround-
ed by a good and sufficient fence for

and unknown owner, are claiming some
right, title and interest in said land de-
scribed above belonging to this plain-
tiff. which is to the plaintiff unknown,

between the hours of ten in the fore-
noon and four in the afternoon, and I
will sell said property all together or in
lota or parcels, as may to me then
seem best, ami 1 will sell said property
to secure the balance due ujion said
notes, principal and interest, together
with costs and exjiense of executing
this trust, including ten |>er cent trus-
tee’s fees, and the further cost of exe-
cuting this trust in Jeff Davis and
Brewster Counties on August 6th,
1913, in the sum of $100.00 which has

deed of trust provided for, and 1 will
make to the purchaser or purchasers of

cash; that th** said deed was duly exe-
cuted and delivered to your petitioner
on the said 5th day of May, 1905, by
the said Sheriff. D. S. Barker, in his
official capacity, and that said deed was
by your petitioner duly recorded in the
Deed Records of Pecos County, Texas,
and has been so duly recorded for more
than five years, before the bringing of
this action, and that plaintiff has had
peaceable and adverse possession of
the said tracts of land, cultivating, us-
ing and enjoying the same, and paying
taxes thereon for five years before the
beginning of this action, and that the
plaintiff has had the said lands enclosed
with agood and sufficient fence entirely
around all of r*aid lands for five years
before the bringing of this action.
Plaintiff further represents that the
said George R. Brown, and the legal
heirs of the said Geo R Brown, and
unknown owner, and the said Z. J.
Green, are claiming some right, title
and interest in the said land of the
plaintiff, to him unknown, and that
their claim is a cloud upon the title of
plaintiff upon the said tracts of land,
to his damage in the sum of $500.00.
Wherefore, plaintiff prays that cita-
tion by publication be issued in terms
as required by law, and that on the
final hearing of this cause he have
judgment for title and possession of
the said above described lands and
premises, and for judgment for re-
moving cloud from the plaintiff’s title
thereto, and quieting plaintiff in said
title, and for writ of restitution and
i for auch other and further relief, both
general and apecial, in law and in
equity, as he may be juatly entitled to
and in duty bound will ever pray.
