Council, chief accept
bartered compromise
By William Hoover
Anvil Herald Correspondent
Hondo City Council members
Tima Barrientes, Trine Cuellar, and
Jose Ytuarte voted to accept an al-
ternative resignation from Police
Chief Marvin Ivy during a special
meeting held last Thursday night.
The modified retirement resigna-
tion was a compromise which allowed
council to remove Ivy from office
immediately, yet still permits the chief
to collect his full retirement benefits.
Under the new terms, Ivy agreed
to be placed on a paid leave and sur-
render his responsibilities of chief on
Monday, Nov. 22. In return, council
will keep Ivy in the employment of
the city until his preferred resigna
lion date of Jan. 31,2000.
Some people complained the chief
would receive over two month’s sal-
ary with no return for the city. Coun-
cil members dismissed the com-
plaints of citizens, saying there
would be significant expenses in-
curred regardless of how they chose
to release the chief.
The only way for council to avoid
any extra expenses would have been
to accept the chief’s original resigna-
tion tendered Nov. 3. However, coun-
cil voted 3-1-1 on Nov. 15, to reject
the city manager’s decision to accept
the resignation which allowed Ivy to
serve as chief until the end of January.
The special meeting took less than
five minutes as Acting City Manager
Bea Cervantes already had Ivy’s sig-
nature on the compromise termina-
tion council had agreed to accept.
All that was left to complete the task
was to take a vote.
“Chief Ivy has submitted a new res-
ignation to the acting city manager,”
Mayor Jim Barden told the quorum
of council members. ‘The acting city
manager has accepted a resignation
which provides retirement on Jan. 31,
2000, but puts the chief on leave ef-
fective Monday, Nov. 22.”
Barden noted council members
Judy Winkler and Ed Stitcler were
at a Texas Municipal League Con-
ference in Dallas, along with City
Manager David Chavez
Holding true to their statements of
wanting to allow Ivy to collect Ins
maximum retirement benefits, coun-
cil reviewed the resignation and.
without discussion, Ytuarte mo-
tioned to accept the modified resig-
nation as presented. Cuellar sec-
onded the motion, which passed by
a unanimous 3-0 vote.
“Until further notice, Lt. Don Ber-
ger will serve as Interim Chief and
we will begin an official search (for
a permanent chief) as soon as pos-
sible,” said Barden
“Thank you all for showing up at
such a late hour.” said Barden
When the meeting was over,
Barden explained what had happened
after council rejected Ivy's resigna-
tion Monday night. “The chief altered
his resignation to reach a compromise
with council." said Barden "Chief
and council came to terms on Ins leav-
ing, so it was a short meeting tonight."
Barden noted Ivy had served the
second longest term of any Hondo
Chief of Police in the last 25 years.
“Only Jerry Smith served longer, at
11 years," said Barden. "Ivy served
five years and the average tenure for
the chief is two to three years."
The compromise offer to Ivy read,
"This will accept your resignation/
retirement effective Jan. 31, 2(XX),
subject, of course, to the consent of
the city council. As of Monday, Nov.
22, 1999, you will begin a paid leave
of absence with the City of Hdndo

THANKSGIVING HELPERS... Karen Muenmnk’s Nutrition and Food Science students from Hondo High
School were able to lend a helping hand for the Community Thanksgiving Dinner Thursday. The stu-
dents browned 30 loaves of bread and broke it up for “ie dressing that would be made later in the week.
Students included left to right (top row) Sarah Highsri, .h, Petra Garza, Steven Valadez, LeRoy Guajardo,
Ricky Harris, Ray Garza, Andrew Kammer, (seated) Crystal Juarez, and Tony Currier. Not pictured:
Agrapina Rodriguez, Marlene Morales and Zenaida Jimenez. The Community Thanksgiving Dinner will
be served at St. Paul Lutheran Church Annex from 11 a.m. to 2 p.m. Everyone who is alone, needy or
without a Thanksgiving meal, is invited to participate. Volunteers are welcome to help.
Owls advance; West Oso next
lasting until your effective retirement
date of Jan. 31,2(XX). Your paid leave
of absence will be at your current
salary and appropriate benefits until
said retirement date."
The paid leave removes Ivy from
the city’s top law enforcement posi-
tion immediately, according to
council’s wishes. The later retire-
ment date accommodates Ivy and
translates into a $26,(XX) difference
in his lump sum retirement payment
“I think this decision will make cv
crybody happy," said Barrientes as
she left City Hall grounds.

A Hondo ISD school bus carrying
nine Meyer and 10 McDowell School
students was struck by a Garbage Gob-
bler truck about 8:30 a.m. Monday.
The accident happened at the intersec-
tion of Avc. R and 20th St.
Hondo Police and Community EMS
personnel were called to the scene.
Due to the number of passengers, EMS
personnel from Castroville, Sabinal
and Devine responded to the local
EMS crews’ call for assistance.
According to Clyde Parsons, assis-
tant superintendent, “Sixteen out of
the 19 students were transported to
Medina Community Hospital where
they were treated and released. Most
were only bumped or shaken up, al-
though one student did sustain a bro-
ken wrist. The driver was transported
with a head injury und was under ob-
servation at last check."
"Some of the students went on to
school, in another bus with the school
nurse in attendance, but later com-
plained of possible injuries. For the
children’s safely, any who com
plained were sent to the hospital for
evaluation." Parsons said.
The garbage truck reportedly failed
to yield right of way to the bus. The
driver was cited for that violation and
for an expired inspection slicker.
Garbage Gobbler’s insurance has
agreed to lake care of all llic hospital
bills, according to Parsons.
