What! Another ordinance?
Part of the charm, here in Double Oak is that we try really hard not to intrude in the daily lives of our citizens.
We do want to help maintain property values and the overall look and feel of the town. Your neighbors don’t
like to look at junk cars or unkempt lawns with high grass. The ordinances that specify keeping these things cleaned up
are a noticeable difference between a home within town limits, and one in an unincorporated area.
In the spring, some of us want to let the wildflowers grow. I have a neighbor that had a beautiful stand of “Indian
paintbrush” this year. It has a vivid red bloom, and he had trimmed the area into a neat rectangle. Our ordinance does
not permit it, but nobody complained. It was visible a few weeks and then gone.

Another home had a yard that looked like a meadow. The growth was quite high, but did contain some wildflowers. The
homeowners liked the look and wanted to encourage the growth of wildflowers. Neighbors complained, and visits by the
Code Enforcement Officer and the Mayor followed. It was clear to me that we were dealing with good, earnest, law-
abiding people. To them, it was beautiful. To others, it looked like a vacant house!

Eventually, we evolved some compromises. Some of the wildflowers stayed. But what about next year? The meadow
is still against ordinances. The neighbors are still not overjoyed with the compromises. The answer was to try to modify
the ordinance to permit more freedom. That’s one of the issues that the council wrestled with in our meeting on August
16th. Council member John Dondrea had written some specifications for a change. I believe that he deliberately made
them in a way to provoke discussion.
If a discussion was what John wanted, that’s what we had. Pretty much everyone that attended spoke on the issue.
Restricting the clutter from the front of the house seemed to be a common theme. In fact, there was about an hour of
discussion before we shut it down. When we were nit-picking about how high and how wide, etc. one councilman
almost gave up in disgust. We resolved to be careful that whatever rules were made, that we try to make them enforceable.
While all this was under discussion, we also considered the difference between residential property (Ranch Estates
zoning) and property zoned for agriculture. Certainly one has to have meadow to graze animals. What about Ag
zoning when no animals are kept? It was an active night but it did restrict those of us that were interested in watch-
ing the Olympic games.

Finally, enough information was gathered to construct an ordinance. Again, John Dondrea took the point position and
will work on a draft to be considered later in the fall..

The Double Oak Town Council met at 7:00
p.m. in regular session on July 6, 2004, at
Double Oak Town Hall, located at 320
Waketon Road with the following
members present: Dick Cook, Mayor,
Tracy Miller, Mayor Pro-Tem, Council
Members: John Dondrea, Mike Donnelly,
David Mize and Tom Pidcock constituting
a quorum. Also in attendance were Town
Attorney David Berman, Town Engineer
Jeff Crannell, Police Chief Tom Sanders
and Town Secretary Charlotte Allen.
Mayor Cook called the meeting to order
at 7:02 p.m.
Mayor Pro-Tem Miller gave the invocation
and Council Member Pidcock lead the
pledge of allegiance.
II. CONSENT AGENDA - All consent agenda items listed are considered to be
routine by the Town Council and will be enacted by one motion. There will be
no separate discussion of these items unless a Council Member so requests, in
which event the item will be removed from the Consent Agenda and considered
in its normal sequence on the agenda. Information concerning consent agenda
items is available for public review.

been moved to the
new server and the
Council email
addresses were
again functioning.
Town Engineer
Jeff Crannell
reported that the
County had asked
him to intervene with the Chinn Chapel
drainage project. A bid had been received
from Allstate for pothole repair. The
flowable fill on South Forest had been
delayed, but would be accomplished.
Police Chief Tom Sanders was available
to answer questions.
Mr. Oscar Burchard, Chairman of the
Planning and Zoning Commission, reported
that the rezoning petition on the Gill property
had been tabled and would be considered
in concert with the preliminary plat at the
July meeting.
I. CITIZENS COMMENTS: NON-
AGENDA SUBJECTS
Ms. Candy Lamel, 210 Cedarcrest Lane,
spoke regarding the Council changing
meeting nights to Tuesday stating the
Double Oak Women’s Club met on the 1st
and 3rd Tuesdays of the month and asked
the Council to make a decision soon so the
club could set their schedule. If the Council
moved to the 2nd and 4th Tuesday for
meetings, in November it would conflict
with elections and the club’s auction.
Mr. Ted Mayes, 171 Cedarcrest Lane,
spoke regarding a drainage issue at the
back of his property due to the vineyard.
A drainage study of the area was needed.
Mr. Bruce Benard, 320 Valley View Trail,
spoke regarding a drainage issue on his
property. A landscape architect had scoped
the property and had said there was not a
4" drop but a 1" rise. He felt the engineer
position should be bid and the town should
look for a new engineer.
Ms. Jolene Barr, 170 Trailing Oaks, spoke
for the Double Oaks Women’s Club
echoing Ms. Lamel’s comments and asked
the Council to especially consider the club’s
November auction.
II. NEW BUSINESS AGENDA
(CONSIDERATION AND
ACTION):
1. Consideration and action on an
ordinance amending the
Comprehensive Zoning Ordinance,
of Chapter 14 (“Zoning”) of the
Code of Ordinances to rename the
Business Office Park district to the
Business District, to provide for
changes in use regulations, area
and height regulations, buffer zone
requirements and masonry exterior
requirements; providing for
changes to the Specific Use Permit
district regulations to repeal day
care centers from the list of uses
for which a SUP is required and to
add a new category for any use
that is not detrimental to the town
or surrounding neighborhoods

2. Consideration and action on a
resolution authorizing the Town of
Double Oak to become an
intervener in the Upper Trinity
Regional Water District’s petition
for Expedited Declaratory
Judgement
This item was moved up in the agenda
order.
Mayor Cook recognized Flower Mound
Mayor Jody Smith, Council Members Tim
Trotter, Paul Stone, Joel Lindsey and Town
Manager Van James from the audience.
Mr. Van James, Town Manager, Town of
Flower Mound, stated the issue was the
unified rate structure. It was felt the
southern area should not subsidize the
development in northern Denton County
and a different rate structure should be
reconsidered. In the policy adopted by the
first Board, the establishment of cost
centers had been suggested and Flower
Mound was asking the District to honor
their commitment. The bulk of the CIP was
for the northern portion of the district and
the current rate structure would be
devastating to Flower Mound. He believed
Flower Mound was taking the side of all
entities in the southern portion of the
district.
Mr. Oscar Burchard, President of the
Board, Upper Trinity Regional Water
District, stated the petition was for an
expedited judgment and felt the issue
should be resolved in court. As the
representative from Double Oak, he felt
the issue was should the Board of Directors
be able to make decisions that were binding
on all members. The Flower Mound
lawsuit claimed rate problems and
overcharges and was seeking damages.
If Flower Mound prevailed, the District
would have to recover costs from all from
