Dr Pepper Building Still Endangered
All Urged to Attend July 22 Meeting At Unity ChurchIf you care about the Dr Pepper
Building, one of Dallas' favorite
landmarks, here is your chance to voice
your concern -and be heard!
A public meeting will be held on
Thursday, July 22, at 7:30 p.m. at the
Unity Church (Greenville at
McCommas).
Representatives from Kroger,
DalMac, DART, the AIA, and HPL will
review and discuss development plans
for this treasured art deco structure and
site.
Two-thirds of the 15-acre site has
been sold by DalMac of Richardson to
Kroger Co. for a 65,000-square foot store,
which will be its largest in the Dallas
area. The foreclosed property finally was
sold to DalMac by the FDIC in May after
legal challenges by the National Trust for
Historic Preservation and the Historic
Preservation League of Dallas.
Preservationists are now seeking a
rehearing from the U.S. Court of Appeals
for the District of Columbia Circuit,
asking that the Court reconsider its
dismissal of their complaint and that the
District Court be ordered to vacate the
sale to allow the Court to decide whether

Conference Topic
A proposed conference on usage of
the Dr Pepper Building and land will
explore several topics, including its
adaptive reuse, says Bob Moss, who is
organizing the day-long seminar
He has sent a copy of the conference
proposal to the Historic Preservation
League, Dallas Landmark Commission,
DART, the City of Dallas Economic
Development Director, Dal- Mac, Kroger,
and others concerned.
"All parties indicate such a confer-
ence would be beneficial," says Bob, "but
we haven't decided on the date yet."the FDIC must comply with Section 106
of the National Historic Preservation
Act.
The Appeals Court recently ruled
that a provision of the Federal Banking
Law prevents the court from issuing an
injunction against the FDIC.
"What we want in seeking
compliance with Section 106 is for the
FDIC to take a hard look at the
consequences of its actions and to
consider what else might be done...",
Alexandra Acosta, assistant general
counsel for the National Trust, says in
the current issue of the Trust's
newsletter "We want the FDIC to
consider alternatives to what appears to
be certain demolition."A recent ruling by the Court of
Appeals for the Fifth Circuit on a similar
case filed by the Lone Star Chapter of the
Sierra Club and the Frontera Audubon
Society against the FDIC under the
National Environmental Protection Act
might have some positive bearing on the
preservationists' cause with Dr Pepper
and other historic structures.
In that case, the Sierra Club asked the
Court to block the FDIC sale of a
property in South Texas known as La
Playa del Rio. The Court ruled that the
FDIC had to comply with the National
Environmental Protection Act. A Federal
Court has the power to enjoin the FDIC
from selling a property.

the annual membership meeting. Shown with Peggy are Mary Crawford, new Trustee,
and Joe Rucker, who continues on the Board. Besides serving as secretary of the League
and chair of the Farmstead Council this past year, Peggy was "of enormous help in so
many other projects, and well deserves this honor, " said Virginia McAlester.I
