formation obtainable it appears that
the tragedy grew out of a cattle steal-
ing controversy yesterday afternoon
at which Jim Huunlcut Joo 1olser
P II Humphries and John Herndon
were present and during which Hum
phries is alleged to hae accused Polser
of stealing a cow Polser is an ex
peuitentlary convct from Dallas coun-
ty having served three years at
Huntavllle for cattle stealing and re-
turned to Dallas something over a
year ago
The trouble yesterday afternoon was
adjusted and all hands took a drink at
Polsers expense and apparently a
permanent peace was concluded Hid
the parties separated About mid-
night the parties met again In the
fame place and Humphries renewed
the abuse of Polser reiterating the cat-
tle stealing charge and a collision uos
imminent when friends readjusted
matters and Polser set up the
drinks nil around once more
Polser then Informed the party that
he had done eTerythiug of u convivial
character that he intended to and
that if any dissatisfaction existed they
could all go to hell He then started
to leave the saloon when Humphries
felled him with a chair us he stood
near the door Almost simultaneous
with tills assault a pistol shot rung out
from outside the saloon and Hum
phries fell with a bullet penetrating
his breast passing through ills body
making Its exit near the spine
Polser walked into tha saloon laid his
pistol with three empty chambers be
hind the bar and remarked Hell
never cut anybody else Humphries
was Immediately placed under the
care of two surgeons but he died In
about an hour Before expiring be
made an antemortem statement to the
effect that Jim Hunuicuttdidtheshoot
ing and that he Humphries saw
him lire the shot from outaide the sa
loon Hunnicutt lied at the time of
the shooting aud bus not yet been ap
prehended
Joe Polser declares that Hunnicutt
Is innocent of the shooting and that
lie himself killed Humphries in self
defense The geivral impression Is
however that Hunnicutt U the real
os assin and that Polser is endeavor-
ing to shield him from prosecution or
fix tilings so he can not be convicted
on account of the clashing of testi-
mony fchould the case come to trial
A coroners Jury today returned the
following verdict We the jury Hud
that deceased came to his death on the
night of June 16 A D JSS4 from the
effects of a gunshot wound that en-
tered his right breast about two Inches
below a line between tho nipples and
came out nt a point about two
inches above the right hip but we fail
to agree as to who did tue shooting
This verdict is perhaps the only case
on record where a coroners jury bung
Three of the jury were In favor of find-
ing a verdict In accordance with the
djing declaration or Humphries
while the other three were in favor of
basing their verdict on the testimony
of the eyewitnesses Tho grand jurv
took up the case this morning ami the
same witnesses who testified before
the coronera jury were taken before
them
Both parties to theshootlng belong to
what Is known as the Soyene gaug
and they are known astougli citieus
They have devoted most of their time
aud talent to getting into nnd getting
out of scrapes of various kinds Pol
ser has served ono term in the pen for
cattle theft and has been in no end
of fights Humphries the deceased
bore a number of scars made by knives
or pistol balls He raised a row at a
dance at tho Long Branch
about a year ago and got a bullet
through his side from a
pistol in tho bauds of a boy he was
trying to bulldoye Hunnicutt who
Humnhrels believed llred the fatal
shot Is also a member of tho Soyene
gang and he enjoyo a reputation as-
a tough which will lose none of its
luster by comparison with the tough-
est He Is now under indictment for
shooting Richard Douglas an bumblo
and Inoffensive negro simply because
the negro was a witness in a case pend
ing against hint for alleged theft of
horses from Adam Bergmann and for
shooting the latter Douglas was
scrubbing the floor of the Stockyard
saloon when ho was shot from the
ouUlde He survived the
wouud and says that
he plainly paw Hunnicutt when he
shot him Public sentiment in Dallas
is that it would be a good thing for the
community If UieScyene gtug would
get up a row among thenimlves of
which there would bo no survivors
The grand Jury would receive no word
of censure Kit should fill to go slow

April 2U 1S84 to Lieut Punamsee of
the Indian pollco was sent to Dr H
A Lewis of this place with a request
to have It published and was today
shown to your correspondent by Dr
Lewis Mr Hunt orders the lieuten
ant to see that no cattle brought on
the railroad to Wichita Falls be driven
through the Comanche and Ktown res
ervations and to Use such force as Is
necessary to carry out the order Cat
tlemen will see from this that thev
must continue tn drive on tho old
trail through tbe Panhandle
Mr 1 Io sack of Han Antonio the auc
tioneer who officiated ut the original
sale of town lota here will be up again
on Thursday of this week to make an
auction sale of a number of shorthorn
cattle for Knott Brothers of this place
Though the weather is warm busi-

Shipping of beef cattle to Chicago
has begun In earnest and seventeen
car loads were shipped yesterday

a storm which lasted about half an
hour and did considerable damage
