THE STATE OF TEXAS

WHEREAS on the 2nd day of
January A. D., 1950, Lamar Coun-
ty Levee Improvement District
No. 1, Plaintiff, recovered a judg-
ment in the District Court of Del-
ta County (for the 8th Judicial
District of Texas) No. 4688 on
the docket of said Court, against
Kenneth Herrin and Eston Her-
rin of Delta County, Texas; Ho-
mer Herrin of Hopkins County,
Texas; Mrs. Cleo Birmingham and
husband, Joe Birmingham, of Dal-
las County, Texas; Arnold Her-
rin of Camp County, Texas; Er-
nest Herrin and Mrs. W. 1. Her-
rin of Cooke County, Texas; Ger-
trude Herrin Haines, a feme sole,
whose residence is unknown, for
the aggregate sum of Two Thou-
sand Two Hundred Seventy-Five
& 92/100 ($2,275.92) Dollars for
delinquent taxes, interest, penal-
ties and accrued costs on the
same, with interest on said sum
at the rate of 6% per annum
from date of judgment together
with all costs of suit. Said judg-
ment directs that foreclosure of
plaintiff’s lien together with lien
of the taxing units which were
parties to this suit and establish-
ed their claims thereto for the
amount of said taxes, interest,
penalties and accrued costs as
apportioned to each tract and/or
lots of land as described in said
order of sale.
By virtue of an order of sale,
issued by the Clerk of the District
Court of Delta County, Texas, on
the 30th day of January 1950, as
directed by the terms of said
judgment.
As Sheriff of said Delta Coun-
ty, I have seized, levied upon and
will, on the first Tuesday in
March, 1950, same being the 7th
day of March, 1950, at the court-
house door of said Delta County,
between the hours of 2 o’clock
P. M. and 4 o’clock P. M. of said
day, proceed to sell for cash to
the highest bidder all the right,
title and interest of the above
named defendants in and to the
following described real estate
levied upon the 31st day of Jan-
uary, 1950, as the property of the
above named defendants.
Description
All that certain tract or parcel
of land situated in Delta County,
Texas, and being more particular-
ly described as being a part of the
Jas. S. Bridges :urvcy, ?.s fol-
lows, to-wit:
BEGINNING at the NE corner
of said survey,
THENCE West 900 feet,
THENCE South 3801 feet,
THENCE East 900 feet.
THENCE North 3301 feet to
the place of beginning. Contain-
ing 68 acres of land, 44.16 acres
of the above tract being reclaim-
ed land against which benefits
are assessed.
Amount Apportioned Against
Said Tract $2,275.92 subject, how-
ever, to the right of redemption
the defendants, or any one in-
terested therein, may have, and
subject to any other and further
rights the defendants, or any one
interested therein, may be entitled
to under the provisions of law.
Said sale to be made by me to
satisfy the above described judg-
ment and foreclosing the lien pro-
vided by law for the taxes, in-
terest, penalty and costs. The
proceeds of said sale to be ap-
plied to the satisfaction thereof.
Said sale will be made subject
to the defendants’ right to re-
deem the said property by com-
plying with the provisions of law
in such cases made and provided.

ton and E. A. Hooks, individually

ship firm of Barton & Hooks Gro-
