the application of such provision to other persons and circumstances shall nevertheless
be valid, and the Board hereby declares that this Order would have been enacted
without such invalid provision.
SF.CTTON 11. It is officially found, determined, and declared that the
meeting at which this Order is adopted was open to the public and public notice of the
time, place, and subject matter of the public business to be considered at such meeting,
including this Order, was given, all as required by Chapter 551, as amended, Texas
Government Code.
SECTION 12. This Order shall be in force and effect from and after its final,
passage, and it is so ordered.

TAKE NOTICE that an election will be held in the Archer City Independent
School District of Archer County, Texas, on November 1, 1997, in obedience to an order
duly entered by the Board of Trustees of the District on September 8, 1997, which
order reads substantially as follows:
AN ORDER CALLING A BOND ELECTION TO BE HELD BY" THE ARCHER (DISTRICT SEAL)
CITY INDEPENDENT SCHOOL DISTRICT, MAKING PROVISION FOR THE
CONDUCT OF THE ELECTION, AND RESOLVING OTHER MATTERS
INCIDENT AND RELATED TO SUCH ELECTiON.

WHEREAS, the Board of Trustees (the Board) of the ARCHER CITY
INDEPENDENT SCHOOL DISTRICT located in Archer County, Texas (the District)
hereby finds and determines that an election should be held to determine whether the
District shall be authorized to issue bonds of the District in the amount 3nd for the
purpose hereinafter identified; and
WHEREAS, the Board hereby finds and determines that the necessity to
construct various capital improvements within the District necessitates that it is in the
public interest to call and hold a bond election at the earliest possible date to authorize
the issuance of general obligation bonds for the purpose hereinafter identified; and
WHEREAS, the Board hereby finds and determines that the holding of a bond
election on the date set forth below, a date other than a uniform election date, is in the
public interest; now, therefore,
BE IT ORDERED BY THE BOARD OF TRUSTEES OF THE ARCHER CITY
INDEPENDENT SCHOOL DISTRICT THAT:
SECTION 1. An election shall be held on the 1st day of November, 1997
in the ARCHER CITY INDEPENDENT SCHOOL DISTRICT, which date is forty-five
(45) or more days from the date of the adoption of this order (the Order) for the
purpose of submitting the following proposition to the qualified voters of the District:
PROPOSITION
"Shall the Board of Trustees of the Archer City Independent School
District be authorized to issue and sell bonds of the District in the
principal amount of $1,750,000 for the purpose of constructing and
equipping school buildings in the District, such bonds to mature serially
or otherwise not more than forty (40) years from their date; any issue or
series of such bonds to bear interest per annum at such rate or rates
(fixed, floating, variable, or otherwise) as may be determined within the
discretion of the Board of Trustees, provided that such rate or rates of
interest shall not exceed the maximum rate per annum authorized by law
at the time of the issuance of any issue or series of such bonds; and shall
the Board of Trustees of the District be authorized to levy and pledge, and
cause to be assessed and collected, annual ad valorem taxes on all taxable
property in the District sufficient, without limit as to rate or amount, to
pay the principal of and interest on the bonds?"
SECTION 2. The school election precincts hereby established for the
purpose of holding the election, the County election precincts included within the school
election precincts, the polling places hereby designated for holding the election in the
school election precincts, and the Presiding Judges and the Alternate Presiding Judges
hereby appointed for holding the election in the school election precincts are identified
in Exhibit A to this Order, and this exhibit is incorporated by reference for all
purposes.
The Presiding Judge named above shall appoint not less than two (2) nor more
than four (4) resident qualified voters of the County to act as clerks in order to
properly conduct the election. To the extent required by the Texas Election Code, as
amended, or other applicable law, the appointment of these clerks must include a
person fluent in the Spanish language to serve as a clerk to render oral aid in the
Spanish language to any voter desiring such aid at the polls on election day. If the
Presiding Judge appointed actually serves, the Alternate Presiding Judge shall serve
as one of the clerks. In the absence of the Presiding Judge, the Alternate Presiding
Judge shall perform the duties of the Presiding Judge of the election precinct.
On election day, the polls shall be open from 7:00 a.m. to 7:00 p.m.
The Archer City (City Hall), 118 South Sycamore, Archer City, Texas 76351,
which is a public place within the District, is hereby designated as the main early
voting location. Tonya Mooney (whose mailing address is 118 South Sycamore, Archer
City, Texas 76531) is hereby appointed as the Early Voting Clerk to conduct such early
voting in the election. This office or place shall remain open to permit early voting
from 8:00 o’clock a.m. to 5:00 o’clock p.m. each day with the exception of Saturdays,
Sundays, and official State holidays. The Early Voting Clerk shall appoint the Deputy
Early Voting Clerks. Branch early voting shall also be conducted at the Varsity
Football Field Annex, 600 South Cedar, Archer City, Texas 76531, on October 17, 1997
from 6:30 p.m. to 9:00 p.m. and Vi McBride is hereby appointed as the Deputy Early
Voting Clerk. Early voting shall commence on the 17th day before the election and
continue through the 4th preceding the date of the election all as provided by the
provisions of the Texas Election Code.
An Early Voting Ballot Board is hereby established for the purpose of processing
early voting results. Melissa Graves is hereby appointed the Presiding Judge of the
Early Voting Ballot Board. The Presiding Judge shall appoint not less than two (2) nor
more than ten (10) resident qualified voters of the District to serve as members of the
Early Voting Ballot Board.
SECTION 3. . Voting machines may be used in holding and conducting the
election on election day; provided, however, that if the use of voting machines is not
practicable, then in that event, electronic voting devices may be used in conducting the
election on election day; provided, however, in the event the use of such electronic
voting devices is not practicable, the election may be conducted on election day by the
use of paper ballots. Paper ballots may be used for early voting by personal appearance
and by mail.
SECTION 4. The official ballots shall be prepared in accordance with the
provisions of the Texas Election Code, as amended, so as to permit voters to vote "FOR"
or "AGAINST" the aforesaid proposition which shall appear on the ballot substantially
as follows: ,
PROPOSITION
"THE ISSUANCE OF $1,750,000 OF SCHOOL BUILDING BONDS TO
CONSTRUCT AND EQUIP SCHOOL FACILITIES AND THE LEVYING
■ OF A TAX IN PAYMENT THEREOF."
SECTION 5. All resident, qualified voters of the District shall be permitted
to vote at the election, and, on the day of the election, such voters shall vote at the
designated polling places. The election shall be held and conducted in accordance with
the provisions of the Texas Election Code, as amended, except as modified by the
provisions of the Texas Education Code, as amended, and as may be required by law.
To the extent required by law, all election materials and proceedings shall be printed
in both English and Spanish.
SECTION 6. A substantial copy of this Order shall serve as proper notice
of the election. This notice, including a Spanish translation thereof, shall be published
at least one time in a newspaper of general circulation ih tfye District, and the
publication of this notice of election shall occur in such newspaper not more than thirty
(30) days and not less than ten (10) days before the day of the election. Additionally,
this notice shall be posted on the bulletin board used for posting notices of District
meetings not later than twenty-one (21) days prior to election day.
SECTION 7. The recitals contained in the preamble hereof are hereby
found to be true, and such recitals are hereby made a part of this Order for all purposes
and are adopted as a part of the judgment and findings of the Board.
SECTION 8. All orders and resolutions, or parts thereof, which are in
conflict or inconsistent with any provision of this Order are hereby repealed to the
extent of such conflict, and the provisions, qf this Order shall be and remain controlling
as to the matters ordered herein. W
SECTION 9. This Order shall be construed and enforced in accordance
with the laws of the State of Texas and the United States of America.
SECTION 10. If any provision of this Order or the application thereof to
any person or circumstance shall be held to be invalid, the remainder of this Order and

eleccion en los precintos escolares estan identificados en el
Documento de Prueba "A” que esta adjunto a esta Orden, y este
documento de prueba esta incorporado por referenda en todos
sentidos.
El, ’ Juez Presidente que esta nombrado arriba nombrara
a entre dos (2) y cuatro (4) votantes habilitados que residen
en el ( Distrito para servir como escribanos para mane jar la
eleccion aprOpiadamente. Hasta el punto requerido por el Codigo
de Elecciones de Texas, como enmendado, u otras leyes aplicables,
el nombramiento de estos escribanos debera incluir una persona
que sepa bien el espanol para servir como escribanos para prestar
ayuda oral en espanol a( cualquier votante que desea dicha ayuda
en los sitios de votacion el dia de las elecciones. Si el Juez
Presidente que esta nojnbrado sirve actualmente, el Juez
Presidente Alterno servira como uno de los escribanos. Si el
Juez Presidente esta ausente, el Juez Presidente Alterno cumplira
con las obligaciones del Juez Presidente del precinto electoral.
El dia de las elecciones, los sitios de votacion estaran
abiertos de las 7 de la manana a las 7 de la noche.
.La Casa de Ayuntamiento de Archer City, la cual queda
a 118 South^ Sycamore, en Archer City, Texas 76351, el cual es
un^ sitio publico dentro del Distrito, por la presente esta
senalada como el sitio de votacion principal donde se manejara
la votacio'n anticipada. Tonya Mooney (cuya direccion postal
es 118 South Sycamore, Archer City, Texas 76531) por la presente
esta nombrada Secretaria de la Votacion Anticipada para manejar
la votacion anticipada en las elecciones. Esta oficina o sitio
quedara abierto para permitir la votacio'n anticipada de las
8 de la manana a las 5 de la tarde en cada dia, con la excepcio'n
presente Vi McBride esta nombrada Subsecretaria de la^ Votacion
Anticipada. La votacion anticipada empiezara 17 dias antes
de la fecha de las elecciones, todo segun dispongan las
disposiciones del Codigo de Elecciones de Texas.
Por la presente se establece una Junta Sobre la Votacion
Anticipada con el proposito de procesar los resultados de la
votacion anticipada. Por la presente Melissa Graves esta
nombrada Jueza Presidente de la Junta Sobre la Votacion
Anticipada. La Jueza Presidente nombrara a entre dos (2) y
diez (10) votantes habilitados que residen en el Distrito para
servir como miembros de la Junta Sobre la Votacion Anticipada.
SECCION 3. Se podran (utilizar maquinas de votar para
manejar y celebrar la eleccion el dia de las elecciones; con
tal de que, sin embargo, si el uso de maquinas de votar no sea
practicable, luego, en ese caso, se podran utilizar boletas
electronicas para manejar la elecciin el dia de las elecciones;
con tal de que, sin embargo, en caso de que el uso de dichas
boletas electronicas no sea practicable, luego la eleccion se
podra manejar por(Usar boletas de papel el dia de las elecciones.
Tambien se podran usar boletas de papel para la votacion
anticipada en persona y por correo.
SECCION 4. Las boletas^ oficiales se prepararan de acuerdo
con las disposiciones del. Codigo de Elecciones de Texas, como
enmendado, de manera que permitan que los votantes ”oten o "A
FAVOR DE" o "EN CONTRA DE" la antemencionada proposicion que
aparecera en la boleta substancialmente de este modo:
PROPOSICION
"LA EMISION DE $1,750,000 DE BONOS PARA EDIFICIOS
ESCOLARES PARA CONSTRUIR Y EQUIPAR LAS FACILIDADES
DE LA ESCUELA, Y LA IMPOSICION DE UN IMPUESTO EN
PAGO DE ESOS."
A LOS VOTANTES HABILITADOS QUE RESIDEN EN
EL DISTRITO ESCOLAR INDEPENDIENTE DE ARCHER CITY
NOTIFIQUESE que se celebrar^ una eleccion en el Distrito
Escolar Independiente de Archer City del Condado de Archer,
Texas, el 1 de noviembre de 1 997, en cumplimiento de una orden
que fue debidamente iniciada por la Junta de Regentes del
Distrito el '8 de septiembre de 1 997, y la orden lee
substancialmente de este modo:
UNA ORDEN LLAMANDO UNA ELECCION DE BONOS QUE SE
CELEBRARA POR EL DISTRITO ESCOLAR INDEPENDIENTE
. DE ARCHER CITY, DISPONIENDO EL MANEJO DE LA ELEC-
CION, Y RESOLVIENDO OTROS ASUNTOS QUE SEAN INCI-
DENTES Y PERTINENTES A DICHA ELECCION.
VISTO QUE, la Junta de Regentes (la "Junta") del DISTRITO
ESCOLAR INDEPENDIENTE DE ARCHER CITY (el "Distrito"), el cual
queda en el Condado de Archer, Texas, por la presente halla
v determina que se debera celebrar una eleccion para determinar
si el Distrito estara autorizado para emitir los bonos del
Distrito en la cantidad y con el proposito que esta identificado
mas abajo aqui dentro; y
VISTO QUE, por la presente la Junta halla y determina
que la necesidad de construir varias mejoras de^ capital dentro
del Distrito requiere que sea provechoso al publico llamar y
celebrar una eleccion de bonos lo mas pronto posible para
autorizar la emision de bonos de obligacion general con el
proposito que esta identificado mas abajo aqui dentro; y
VISTO QUE, por la presente la Junta halla y determina
que sera provechoso al publico celebrar una eleccion de bonos
en la fecha manifestada mas abajo aqui dentro, y esta fecha
-no es una fecha de eleccion uniforme; ahora, por lo tanto,
ORDENESE POR LA JUNTA DE REGENTES DEL DISTRITO ESCOLAR
INDEPENDIENTE DE ARCHER CITY QUE:
SECCION 5. Todos los votantes habilitados que residen
en el Distrito estaran permitidos votar en la eleccion, y, en
el dia de las elecciones, dichos votantes votaran en los
designados sitios de votacion. La eleccidn se celebrara.y se
manejara segun disponga/ el Codigo de Elecciones de Texas, como
enmendado, excepto segun este modificado por las disposiciones
del Codigo de EducacicSn de Texas, como enmendado, y como pueda
de sabados, domingos, y dias de fiesta oficiales del Estado.
La Secretaria de la Votacion Anticipada nombra^ a los
Subsecretarios de la Votacion Anticipada. La votacion en el
sitio de votaciin auxiliar se manejara en la Parte Anexa del
Campo de futbol, la cual queda a 600 South Cedar en Archer City,
Texas* 76531 . Esta votacion s.e llevara a cabo el 17 de octubre
de 1 997 de las 6:30 de la tarde a las 9 de la noche, y por ja
requerir la ley. Hasta el punto requerido por las leyes, todos
los materiales y procedimientos electorales estaran impresos
en inglds tanto como en espanol.
SECCION 6. Una copia substancial de esta Orden servira
como aviso propio de la eleccion. Este aviso, incluyendo una
traduccion al espanol, estara publicado a lo menos una vez en
un periodico de circulacion general en el Distrito, y la
publicacion de este aviso de eleccion se verificara en dicho
periodico entre diez (10) y treinta (30) dias antes del dia
de las elecciones. Ademds, este aviso estara fijado en la tabla
de anuncios para fijar avisos de las juntas del Distrito dentro
de veintiun (21) dias antes del dia de las elecciones.
SECCION 7. Las declaraciones que estan contenidas en
el preambulo de esto por la presente se hallan ser verdaderas
y por la presente dichas declaraciones se hacen parte de esta
Orden en todos sentidos y estan adoptadas como parte de la
decision y el descubrimiento de la Junta.
Todas las ordenes y resoluciones, o partes
que estan opuestas o contradictorias a cualquier

disposicion de esta Orden por la presente estan revocadas hasta
el punto de dicho conflicto, y las disposiciones de esta Orden
predominaran y seguiran predominando en cuanto a los asuntos
ordenados aqui dentro.
SECCION 9. Esta Orden se interpretara y tendra vigor
segun disponcran las leyes del Estado de Texas y los Estados
Unidos de America.
SECCION 10. Si alguna diposicion de esta Orden o la
aplicacion de esta a alguna persona o circunstancia se declara
invalida, el resto de esta Orden y la aplicacion de dicha
disposicion a; otras personas y circunstancias de todos modos
se considerara valida, y por la presente la Junta declara que
esta Orden se hubiera legislado sin dicha disposicion invalida.
SECCION 11 . Se halla, determina, y declara oficialmente
que la junta en que se adopto esta Orden estuvo abierta al
publico y que se dio aviso publico/ de la hora, lugar y tema
del negocio publico que se considerara en dicha junta, incluyendo
esta Orden, todo segun requiera el Capitulo 551 , como enmendado,
del Codigo de Gobierno de Texas.
SECCION 12. Esta Orden tendra vigor y estara vigente
desde y despues de su aprobacion final, y asi se ordena.
ACORDADA Y APROBADA este dia 8 de septiembre -de 1997.

adoptada, con el proposito de presentar la siguiente proposicion

emision o serie de dichos bonos; y debera de estar
autorizada la Junta de Regentes del Distrito para
imponer y empeKar, y hacer que se tasen y recauden
cada ano los impuestos ad valorem sobre todos los
