II.
The Board of Commissioners does hereby finally determine to assess a part
of the Cost of Such improvements against the owners of property abutting thereon,
and against such abutting property.
(a) The City of Abilene will pay all of the costs of such improvements
in and on all intersections of said portion of street to be improved with other
streets and alleys.
(b) The owners of property abutting upon the portion of street to be im-
proved shall pay the remaining cost of such improvements, but no assessment
shall be made against any abutting property, or the owners thereof in excess
of the actual benefit to such owner in the enhanced value of his property by
means of such improvements, an ascertained at such hearing, nor shall any ass-
essment be made in any case until after the notice and hearing hereby provided
for.

III.
That a hearing shall be given before the Board of Commissioners to the
owners of property aburring upon said proposed improvements and to all others
interested insaid property, said improvements, contract, the cost'and benefits
thereof, or any matter or thing connected therewith, and at such hearing all
said owners, whether named herein or not, their agents or attorneys, and all
others interested or affected shall receive a full and fair hearing of all
matters with reference to said proposed assessments against them and their
property; and any irregularity or invalidity in any proceedings with reference
thereto", or the special benefirs of said improvements to their property in the
enhanced value thereof, or any matter or thing with reference thereto; and
all such owners, whether named herein or not, may at such hearing appear in
person, or by Attorneys and produce evidence and subpoena witnesses. Said
hearing shall continue from day to day and time to time without further notice
until all hive been fully heard. After such hearing has been closed the Board
of Commissioners will, from the evidence before it, determine the amounts to
be assessed, and will by ordinance levy assessments. Such hearing shall be
held and assessments determined, made and levied, and be a lien and liability,
all as are provided by the City Charter and by law, and the proceedings of the
Board with reference thereto. Said hearing shall be held in the City Hall,
in the Cityof Abilene, at 3:00 o/Clock T. M. on the 28th day of August, 1931.
Notice of all said matters and things shall be fiven by advertisement by
causing a copy of this Reso.ution signed by the City Secretary, to be inserted
not less than three times in the Abilene Times, a newspaper published in the
City of Abilene, the first publication to be not less than twenty days before
the said date for said hearing. Notice shall also be given by registered letter
in the manner provided by the City Charter, but such service by letter shall
be only cumulative of said notice by advertisement, which shall be, inall
cases, held valid and binding.

This resolution shall take effect and be in force from and fifter its
passage and approval by the Mayor. r
