Chamber Board of Commissioners
City Hall, City of Abilene, Texas
The Board of Commissioners of the City of Abilene, Texas met in regular
session Friday August 28, 1931 with Mayor York present and presiding.
Commissioners present, Johnson, Morrison^ Womatek and Sammons.
The minutes of the previous meeting were read and approved.
PAYROLL & VOUCHERS Commissioner Morrison made a motion, duly seconded and carried, that
APFftGVED all payrolls presented and approved for payment and all vouchers approved,
Nos. 2883 B to 2931 B. inclusive, be allowed and ordered paid. All Com-
missioners voted ”Aye”.
VOUCHER TO WEST By motion of Commissioners Womack, duly secondedand carried, the City
TEXAS UTILITIE%ecre^arY was authorized to issue vouchers in favor of the West Texa.s Utili-
COMpANY ties Company as follows: General Fund - $3,398.53; Airport Fund - $26.00;
Street & Bridge Fund - 8.26; Park Fund - $9.87; for payment of Gas and
Electric Services for July 1931. All Commissioners voted ”Aye".
VACATION AUTHOR- Commissioner Womack made a motion, duly seconded and carried, that
IZEt)- J .D .BURNS^r • J* Burns and T. J. Morman of the Parks Department be allowed one
T.J.MORMAN weeks vacation, each, beginning August 31, 1931. All Commissioners voted
”Aye”•
BUTTERNUT STREET August 28, 1931 being the day set for the hearing on Improvements on
HEARING Butternut Street from its intersection with the South Line of South Ninth
Street to its intersection with North line of South Fourteenth Street,
• Mr. G. L. Corrie and Mr. H. J. Bradshaw came before the Board and were
sworn in.for testimony. Mr, Corrie stated that he was familiar with the
real estate in the City and that in his opinion -the property abutting on
the street proposed to be improved would be enhanced in value in an amount
equal to the cost of the paving, Mr. Bradshaw stated that he was familiar
with this type of paving to be used and that the price to be charged for
same was a fair and reasonable one.
The Following Resolution was read before the Board.
RESOLUTION CLOSING RESOLUTION CLOSING HEARING WITH REFERENCE TO IMPROVEMENT OF BUTTERNUT
HEARING STREET FROM ITS INTERSECTION WITH THE SOUTH LINE OF SOUTH NINTH STREET
TO ITS INTERSECTION WITH THE NORTH LINE OF SOUTH FOURTEENTH STREET IN
THE CITY OF ABILENE, TEXAS.
WHEREAS, by resolution passed by the Board of Commissioners of the City
of Abilene, on the 14th day of November 1930, it was ordered that Butternut
street, in said City, from its intersection with the South line of South
Ninth Street to its intersection with the North line of South Fourteenth
Street, in the City of Abilene, Texas, be improved and in accordance with
said resolution the City Engineer prepared specifications for such improve-
ments, and thereafter such specifications were adopted and approved, and
bids .were advertised for, and the bid of the West Texas Construction Company
for the making and constructing of such improvements with the Warrenite-
Bitulithic pavement was accepted and contract for the making and constructing
of such improvement was let to it; and
WHEREAS, the City Engineer filed with the Board of Commissioners his
statement, showing the names of the owners of the property abutting on said
improvements, describing the parcels of property, showing the estimated
cost of the improvements, and the proportion proposed to be assessed against
the owners of abutting property and their property, and the estimated cost
per front foot of abutting property, and showing other matters and things
required to be shown bn such statement and appropriate thereto; and by re-
solution passed on the 24th day of July 1931, it was finally determined to
assess a part of the cost of said improvements, and a time and place for
hearing to the owners of abutting property, and to all others interested,
was fixed for the 28th day of August 1931, at 3:00 OtClock P. M. , in the
City Hall in the City of Abilene, Texas, and the City Secretary was directed
to give notice of such hearing and of the time and place thereof; and
WHEREAS, notice of the said hearing of all said matters and things was
given in the manner and form and for the length of time required and pro-
vided by the Charter of the City by the proceedings with reference to the
said improvements; and such hearing was hid at said time and place and
was continued from time to time until all desiring to be heard had been
fully heard; and,
WHEREAS, there has been filed with the Board of Commissioners a revised
statement giving the names of owners of abutting property, description of
the respective parcels of such property, the amounts to be assessed against
the owners of abutting property, and widowing other matters and things; and
WHEREAS, at said hearing the following protests and objections were
made, to-wit:
J. N. McDonald owning 100 front feet in J. N. Fergerson Subdivision
protested that his property was already widened and paved and does not
want it torn up and repaved, and that he is not benefited but injured!
