B. F. Rhodes owning 115 front feet in J, N. Fergerson’s Subdivision
protested that his is his homestead.
WHEREAS, vidence was heard and received concerning all said protests and
objections and concerning all other protests and objections that were made,
whether mentioned herein or not, concerning the said improvements, the regular
ity of the proceedting connected therewith, the validity thereof, the cost of
such improvements, the benefits by means of said improvements, the method of
apportioning the cost of such improvements, and the amount to be levied
against the respective parcels of abutting property and the owners thereof
and concerning, all other matters and things connected with the said improve-
ments, contract therefor and assessments therefor, and the proceedings with
reference thereto.THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS
OF THE CITY OF ABILENE:
That the said hearing be, and the same is hereby closed and all ob-
jections and protests, whether herein mentioned or not, be, and the same are
overruled; and the Board of Commissioners from the evidence before it finds
that in each and every case the property abutting on said portion of said
street and oroposed to be assessed will be and is actually benefitted in the
enhanced value thereof by means of such improvements, and the owners of such
property is in each and everycase actually benefitted in the enhanced value
of his property by means of such improvements in an amount in excess of the
sums proposed to be assessed against the respective parcels of property and
the owners thereof, as shown by said revised statement, and that such sums
are the sums properly chargeable against and assessable to the respective
parcels of property and the owners thereof and that the rule of apportionment
applied produces substantail justice and equality; and the Board of Commis-
sioners orders that such sums shall be assessed against such property and the
owners thereof.
The Board of Commissioners further finds that the total sums assessed
against the Abutting property and the owners thereof do not exceed the amount
which can lawfully and properly be assessed against such property and said
owners under the terms of the Charter of the City of Abilene and under the
proceedings of the Board -of Commissioners with reference to such improvements.
It is further ordered that the corporation counsel prepare and submit
to the Board of Commissioners a form of ordinance levying assessments for such
improvements, fixing liens on the property assessed, and declaring the per-
sonal liability of the owners in accordance with the provisions of the City
Charter and the proceedings of the Board of Commissioners with reference to
the said improvements; and it is directed that the said revised statement
be included in and made a portion of such ordinance.

CE LEVYING ORDINANCE IE VYING ASSESSMENTS FOR A PART OF THE COST OF IMPROVEMENT OF
2NTS- BUTTERNUT STREET FROM ITS INTERSECTION WITH SOUTH LINE OF SOUTH NINTH STREET
JT ST. TO ITS INTERSECTION WITH NORTH LINE OF SOUTH FOURTEENTH STREET, IN THE CITY
OF ABILENE, FIXING A CHARGE AND LIEN AGAINST PROPERTY ABUTTING THEREON AND
AGAINST THE OWNERS THEREOF, PROVIDING FOR THE COLLECTION OF SUCH ASSESSMENTS
AND FOR THE ISSUANCE OF ASSIGNABLE CERTIFICATES IN EVIDENCE THEREOF, AND DE-
CLARING AN EMERGENCY.
By motion of Commissioner Sammons, duly seconded and carried, the above
Ordinance was passed. All Commissioners voted ’’Aye”.
WATER RATE FOR By motion of Commissioner Morrison, duly seconded and carried, the
USERS OUTSIDE water rate for out of City users was changed to the old rate as follows:
CITY LIMITS #1.50 for 5000 Gallon Minimum and 50^ rate per 1000 gallons additional.
All Commissioners voted "Aye”.
APPT. OF BEN F. Commissioner Johnson made a motion, duly seconded and carried, that
LYNCH TO H. F. Wyatt and Ben F. Lynch be placed on the Payroll of the Police Depart-
POLICE DEPT. ment at a salary of $50.00 per month. All Commissioners voted ’’Aye”.
