4 SPECIAL LAWS.
remaining members constitute a quorum of five. Five members shall
constitute a quorum for the transaction of business.
SEC. 11. The assessor and collector of taxes herein provided for
shall give bond in the sum to be fixed by the board of trustees of
said Bowie Independent School District, payable to the President of
said board of trustees, and his successors in office conditioned upon
the faithful discharge of the duties of said office and the payment of
the funds secured by him to the treasurer of the board of trustees
of said Bowie Independent School District. As assessor he shall begin
his duties as such on the first Monday of January of each year
and conclude same and report same to the board of trustees not later
than the first day of April following. He shall receive for his services
as such collector and assessor of taxes such compensation as
the board of trustees may allow, and he shall not be a person employed
by the State or county or any municipality for a similar purpose.
It is expressly provided that said assessor shall not be governed
by the valuation fixed for State and county or city purposes.
SEC. 12. The Trustees of the Bowie Independent School District
shall have the power to levy and collect taxes for the maintenance
of the schools therein, but no such taxes shall be levied until after an
election shall have been held within such district wherein a majority
of the taxpaying voters voting at said election shall have voted in
favor of the levying of such taxes; provided, however, that the tax for
maintenance purposes shall not exceed such ad valorem tax as the
qualified taxpaying voters of such district may determine at an election
held therein for that purpose; provided further, that the petition
for a maintenance tax election, and the order and notice therefor,
shall designate either the specific rate of tax to be levied, or such
rate of tax not exceeding such per cent as may be voted by a majority
vote of all the votes cast at any such election; and, provided, further,
that as the district hereby created is without sufficient funds to maintain
its schools for the scholastic year beginning September 1, 1921,
any tax voted during the current year 1921 for the maintenance of
the schools of said Bowie Independent School District hereby created
shall be and is hereby made collectible for the current year 1921 and
all subsequent years, and may be assessed, levied and collected on or
before the 31st day of January after such election and thereafter
on or before the 1st day of November in each year; and, provided
further, that the manner of holding such maintenance tax elections
shall be governed and controlled by the general laws, except as may
be herein otherwise provided.
SEC. 13. All taxes levied and assessed under this Act shall become
due and payable on November 1st of each year and shall be become
delinquent on January 1st of each year following, and on and after
such delinquency occurs a penalty as now provided by general law
shall accrue and be collectible. All delinquent taxes shall bear interest
at the same rate as delinquent State and county taxes.
SEC. 14. The board of trustees of the Bowie Independent School
District shall be authorized to appoint a board of equalization consisting
of three members who shall not be members of the board of
