‘Coin Toss' Due '
In Rochester Tie
ROCHESTER (RNS) - Officials
at Rochester have decided on a
method of resolving their dilem-
ma over which of two men will
get a post on the Board of Alder-
men.
The two, Phil Simmons and Cur-
tis Love, each received 23 votes
in the April 7 municipal election.
Ironically, neither man wanted the
post in the first place, they say
At first it wad thought one could
just step aside and let the other
have it. But a lawyer informed
the city board it wasn't that sim-
ple. He told them it would be
necessary to "flip a coin and
draw up a paper outlining their
decision and have it notarized "
Simmons said the "coin flip-
ping" would be held as soon as a
lawyer draws up the necessary
papers for him and Love to sign.
He said the law stipulated also
that a witness must be present.

LEGISLATURE
iContinued from Pg. 1-Al
on the reorganization bill, said he
had been given the assurance of
Gov. Price Daniel that the gover-
nor would appoint a part-time
board "He then turned right
around and appointed men who
couldn't serve part time, then the
board went over and picked up—
not a qualified insurance man but
an assistant auditor—and took
him over and said. Mr. Assistant
Audit you run this big insurance
department.'"
All efforts to stick on amend-
ments unfavorable to the finance
committee's budget were tabled.
Only one was a close vote, 14-13,
on an amendment by Sen Abra-
ham Karen Jr. of Laredo to add
$12,000 for field survey work for
the migrant labor council
Other amendments killed would
have cut the citizen members sal-
ary on the Veterans Land Board,
required the Livestock Sanitary
Commission to remain in Fort
Worth, increased the deputy clerk's
salary for an El Paso Court, added
$61,560 to the nursing school at
Texas Western, deposited all un-
expended fund balances into the
general revenue fund and allowed
the Texas.Youth Council to deter-
mine the location of the new school
for delinquent hoys Instead of
building it at Gatesville
Also accepted were two minor
amendments allowing the Board of
Professional Engineers to either
approve plans for housing the de-
partment in the proposed second
state office building or to use their
funds to erect a building else-
where. The second states that the
Galveston Medical Branch of the
University of Texas would not be
required to accept unqualified stu-
dents
A later afternoon session of the
House Revenue and Taxation
Committee produced another
across - the - board tax bill for
legislators' consideration. The bill
by Rep. H. J. Blanchard would
levy a gross receipts tax to raise
about 200 million dollars annually. 1
A general tax bill, combining
features of several proposals, was
laid out earlier this week.
The Senate concurred in a House
resolution permitting representa-
tives to debate the session's major
tax bill (HB 727) on Wednesday
or Thursday along with the fran-
chise tax increase proposal (HB
238). Normally, the House must
consider only Senate passed bills
on those days.
'This just gives as the right to
work next Wednesday and Thurs-
day on these two bills if they hap-
pen to be up," said Rep. J. E.
Winfree, Houston. It appeared,
however, the tax bill might be |
debated earlier, perhaps Monday. 1
