John McDermett, made a busi-
ness trip to Emma the first of the
week-
Several of the Crosbytonites
were on the Canon Saturday
night after the finney tribe, and
report a good catch.
Dr. Greer of Emma was in the
city of Crosby ton Monday and
says thing3 look pretty good over
here.
The surveyors are hard at work
making surveys from the Canon
to Crosbyton, they will find a
way out yet, see if they don't.
TheEJitor and family had a
fine day Sunday on the famous
Blanco Canon.
W. - H. Ellison, has several
prospectors out this week and
gays he will sell some of them
land and they will soon be located
among us.

Died at Emma

Last Tuesday afternoon
death angel invaded the home of
Mr. and Mrs. IV. A. Foster, and
took from them theironly child,
little Gertrude. Gertrude was a
bright, beautiful baby girl, and
while she had been in the home
but ten months, an attachment
was formed that will go with the
fond parents into the great eter-
nity beyond. She had been sick
hut a short-while, Erysipelas be-
ing the cause of her death. At
about 11 o'clock Tuesday morn-

Mrs. Nolan, Monday. The moth-
er and child are doing, well.
Barney Johnson our hustling
real estate man has been spend-
ing the biggest part of his time
out with prospectors, of late and
he has made several sales in the
past few days. . .
, There was something in the
neighborhood of twenty, men on
the canon at work'on the .picnic
grounds Saturday, thats the way
they do things in this country
any way, and everybodv helps.
The Floydada band will make
music for the Crosbyton ; folks 1 *
next Tuesday. Everybody is in-
vited to' attend this meeting and
will be shown the time of their
life in wide-a-wake Crosbyton.
Bring the wife the children
and grandma and grandpa to the
great Crosbyton day the 8th, they
will help make up the largest
crowd ever gathered in Crosby
County.
The fire works that will be dis-
played in Crosbyton the evening
of the eighth of June will no
doubt be the finest ever seen by
many of the South plains people.
The editor is expecting to see
something greater in this respect
than he has seen. You are in-
vited to be here and bring your
family, let the children see.

making publication of this Citation once
in each week for four successive weeltfl
previous to the return day hereof, in
some newspaper published in your
County, if there be a newspaper pub-
lished therein, but rf not, then inany . vi-
newspaper published in the 50th Judicial
District; but if there be no newspaper——«-
published in said Judicial District, then
in a newspaper in the nearest District
to said 50th Judicial District, to appear
at the next regular term of the District
Court of Crosby County, to be holden
at the Court House thereof, in Emma,
on the 19th Monday after the First
Monday in February, A. D. 1909, the
same being the 14th day of June A. D
1909, then and there to answer a peti-
tion filed in said Court on the 19th day
of May A. D. 1909 in a suit, numbered
on the docket of said Court No. 145,
wherein Charles Perky is Plaintiff, and
Kentucky Cattle Raising Company is

Section No. 11, located and surveyed
by virtue of certificate No. 28 124, is-
sued to W. C. Ry. Co., patent No. 183,
volume 18, dated November 2nd, 1899.
Section No. 22 in block No. 2, located
and surveyed by "virtue" of certificate
No. 28 128, issued to W. C. K. C. Co.,
patent No. 138, volume No. 18, dated
November 7th, 1899.
j That the defendant company was the
j owner and holder of said surveys No,
I 14, as the assignee of L. F. Eaton, and
of survey No. 22, as the assignee of
Jere Reese, both of whom had acquired
the same from the state of Texas, un-
der laws enacted by the Legislature of
the state of Texas. While the defen-
dant so owned ana held both of said
sections of land a writ of attachment
was duly issued out of the district^
court of Orosby county, Texas, in cause
No. 52. George W. Frantz vs. the Ken-
tucky Cattle Raising Company and
levied upon said lands, w^t'n other
| lands, and that said lands were ordered '
I to be sold by the court and the same
were sold by the sheriff of Crosby
county, Texas; that said lands were
1 struck off to George W. Frantz at said
sale and that afterwards the purchaser
[itt said-sale caused the balance -of~th > -
purchase money to be paid to the State
of Texas and caused patent to be is-
j sued by the State of Texas, to the de-
fendant herein, which- constitutes- de- '
fendant's sole and only claim to said
| land.
! By reason of the premises plaintiff
j says that the patent so issued to ' the
(defendant company, subsequent to the
! date of said sale, makes, an apparent
| title of record in the name of the de-
I fendant company, which title is not
real, the superior and real title being
; in plaintiff, and because thereof plain-
: tiff now brings this suit to determine
j his right t6 the superior title to said
land.
