Sec. 5. Be it further enacted, That the sum of twenty
thousand dollars in the promissory notes or government bonds,
be," and the same are hereby appropriated for the payment of sup-
plies and services rendered in or for the army or supplies furnish-
ed in the years 1838, 1839 and 1840 ; provided, said accounts
shall be duly authenticated.
Sec. 6. Be it further enacted, That the appropriations
above specified in this bill are intended to be made in the prom-
ises of the government, except the appropriation of fifteen thou-
sand five hundred dollars for the payment of Foreign Agents,
and the-contingent expenses attending the same, and if there is,
or should be hereafter any other money in the Treasury of this
Republic, than the promises of the government, it shall be held
subjeci to the disposition of congress; excepting always, the
amount of fifteen thousand five hundred dollars above specified
in this section.
Sec. 7. Be it, further enacted, That the secretary of.he
treasury, be,- and hes hereby authorized and required to pay it.

'Taxable property to the CountyAssessor. ,
Snc. 1. Ba it enacted by the Senate and House of Repre-
sentatives of the Republic of Texas, in Congress assembled,
That all persons who have failed to give in a list of their taxable
property to the county Assessors for the year eighteen hundred
and forty, be, and they are hereby exempted from double taxa-
tion ; provided, the party so exempted, pay or cause to be paid,
into the hands of the pioper officer before the first day of June
next, the amount of his taxes, as prescribed by an act, approved
January the sixteenth, one thousand eight hundred and forty,
that is to say, one half of one per cent, on the amount of pro-
perly to be assessed.
Sec. 2. Beit further enacted, That this act take effect from
and after its passage.

Sec. 1. Be it enacted by the Senate and House of Repre-
sentatives of the Republic of Texas, in Congress assembled,
That the following duties shall be collected upon all imposts into
the Republic, to' wit : upon all articles on which a specific duty
is laid, there shall be levied and collected a duty double that now
fixed by law, and the ad valorem duties of ten or fifteen per cent.
as"fixed by the act to which thus is a supplement, shall be raised
to'forty-five per cent., except sugar, coffee, salt, iron and steel,
which shall remain as heretofore.
Sec 2. Be it further enacted, That this act shall go into
effect from and after the first of April next.

AN ACT
To Amend an act entitled "An Act to raise a public Revenue
by Direct Taxation," approved January sixteenth, one thou-
sand eight hundred and forty.
Sec. 1. Be it enacted by the Senate and House of Repre-
sentatives of the Republic of Texas, in Congress assembled,
That from and after the passage of this act, it shall be the duty
of the sheriff of each county of this republic, pu receiving the
list provided for In the tenth section of "An Act to raise a Re-
venue by Direct taxation," approved the sixteenth of January,
one thousand eight hundred and forty, to advertise at three or
more public places in each captain's beat, that the tax due from
the citizens of the county will be received at the precincts of said
beats on two particular days to be mentioned: notice to be given
, atf least ten. days preceding: at which time and place he shall
attend and-remain for that purpose.
SccjS. fBe it further .enacted, That any citizen holding
land or other property for himself, as agent, attorney, or admin-
istrator, in anyvother county than that in which he or she may
teside, shall deliver to'the assessor of the county in which they
f ijesfde, a separate list of said land, and property, upon oath ; a
copy ot which shall be forwarded to the clerk ol the county court
in' which said land and property are situated, and shall pay the
tax upon such land and property in the county where they re-
side : "provided, that in all cases they shall pay tax for county
purposesnporrsnch land and property, and that the sheriff so
receiving, slmll pay over the same to the secretary of the treasury
of this republic, to be paid over by that department to the sheriff
ol the county wherejthe lands upon which such tax was paid,
may bo situated.
Sec. 3. Beit further enacted, That there shall be collected
upon the latfd and property mentioned in the foregoing section.
an nniform tax for county purposes, which shall be laid at the
highest rate the law allows.
Sec. 4. Be it further enacted, That every person owning
land or other property in any other county than the one in which
they reside, shall give in the same to the assessor of the county
in which they reside, which shall be forwarded as provided for
in the second section of this act.
sec. 5. Be it further enacted, That that portion of the act
to which this is a supplement, which requires the county sur-
veyor and county recorder to make out and deliver to the asses-
sors of the several counties, an abstract of land titles and field
notes recorded in their respective offices, be, and tho same is
hereby repealed.
Sec. 6. Be it further enacted, That no tax shall be levied
or collected in any county on any pedler or vender of any goods,
wares, or merchandise of any description whatsoever; provided,
the same be of the growth of manufacture of this republic.
Sec. 7. Be it further enacted. That in no instniine kIi.iII

Sec. 10. Be-4t-zrikPiinclcd, That should the Commis-
sioners of Roads and Revenue forTrrry-tcaspn fail to appoint an
assessor for their county, by the first Mondayrn-r5Iarch of each
year, it shall be the duty of the chief justice of the countytbTsake
the appointment within the time prescribed by the act to which
this is a supplement: and should the chiel justice of the county
be unable to procure any individual to accept of the appointment
of assessor, he shall ofier said appointment to the clerk of the
county court of said county, who is hereby required to accept of
said appointment, and discharge the duties pertaining thereto ;
and on his failure to do so, he shall, on conviction thereof before
the district court, be fined in a sum of not more than five thou-
and dollars, at the discretion ot the court be dismissed Irom
office, and be forever thereafter incapable of holding any office
ot honor, proht, or trust, m this government.
Si:c. 11. Be it further enacted, That any clerk, sheriff, as
sessor, coroner, or any other officer, who may resign his office
for tho purpose ot evading a discharge ot their duties, or who
may netr'ect to discharge the same, shall be subject to indictment
for a high misdemeanor, and on conviction thereof, shall be fined
in a sum of not less than five thousand dollars, at the discretion
of the court, and be dismissed from office.
Sec. 12. Be it further enacted, That no individual over
tiieageof forty-five yearshall be compelled to pay poll tax.
SEcriSr Be it further enacted, That'no corporation taxes
shall exceed the amount of taxes raised for county purposes, and
both shall be collected in the same currency as the general taxes.
Snc. 2. Be it further enacted, That this act talce effect from

the regimental boundaries, from time to time, as the increase or
diminution of the population may require ; and that they may
when they deem the public interest may require it, create new
regiments, and designate the boundaries.
Sec 7. Be it further enacted, That the commandants of
regiments be, and they are hereby authorized and required to
make sucli alterations in the boundaries of company beats, as the
increase or diminution of the population may require; and that
they may, when.aTproper organization may make it expedient,
create new; beats,:anddcsignate the boundaries thereof.
Sec 8. Be it further enacted, That all officers who may
have been properly elected, or appointed, or who shall hereafter
be appointed or elected, shall, by this act, have the same authority
as officers, as though they had received their commisssion in due

draft, on the militia, by order of the President, he shall be author-
ized 1o receive volunteers in lieu of drafted men; and that the
said volunteers be authorized to elect their own officers, and re-

mixed froops are called out, part volunteers and part drafted men,
and shall apply to the commander-in-chief, or the commandant
of the expedition so ordered out, they shall be permitted to elect
their own officers; and any companies which shall be called
into service, and not enough to form a battalion, the command
nnt of the expedition bhalfhave power to attach them to auy
other battalion or regiment: and that this act take effect from
and after its passage, any law to the "contrary notwithstanding.

AN ACT
Supplementary to an Act entitled "An Act" Authorizing the
issuing of Duplicate Land Warrants, Discharges, and Head-
rights, on certain conditions.
Sec. 1. Be it enacted by the Senate and House of Repre-
sentatives of the Republic of Texas, in Congress assembled,
That any person who may have lost land scrip or audited drafts,
be, and they are hereby included, in the above recited act, "ap-
proved January the fourteenth, one thousand eight hundred and
forty," by complying with the conditions of the above recited act;
provided, that the owner, if an alien, ofsaidjclaim, shall previous
to the applying for a duplicate of the same, "make or cause pub-
lication to bo made for sixty days in a newspaper published at
tho seat of government of Texas.

Authorizing the Secretary of State-to-draw for the Appropri-
ation to run the Boundary Line.
Resblved by the Senate and House of Representatives of the
Republic of Texas, in Congress assembled, That the Secretary
of State be, and he is hereby authorized and directed to draw
from the war department, or any other department of the gov-
ernment, any amount of par funds whichmay have been appro-
priated by the act of the present session "of Congress, making
provisions for running the boundary line between this republic
and'the United. States of the'North;. and that said Secretary of
State, as early as practicable, forward such amount to George
W. Smyth, Esq., commissioner of this.republic.
