Dear Sir or Madam:
We received your notice dated November 10, 1997 requesting a
payment of $2,240.00 for late filing penalties related to our form
990 for the fiscal year ended August 31, 1996 (copy attached). The
penalty assessed is for 224 days @$10.00 per day. I believe we have
reasonable cause for these penalties to be abated, and that our
return was not filed 224 days late as your notice states.
Our records indicate that the return was filed with the Austin
Service Center on February 16, 1997. In July, we received a letter
asking about our form 990. I responded to the request, and
completed the information section of the form. Along with the
notice, I wrote a transmittal letter, and attached a copy of the
return as it was filed. In my transmittal letter, I specifically
stated that the copy attached was a copy for information purposes
only. Instead, ;3ince apparently the Austin Service Center could not
locate our originally filed return, that return was processed as
the original, upon which your penalty is based. On September 23, I
received another notice regarding our tax return, and responded to
that notice. Not once have I received any response other than a
computer-generated form and now a penalty assessment.
The Texas Human Rights Foundation is a very small organization
with no employees and very few volunteers. We provide free services
to persons with AIDS who have been discriminated against on the
basis of their HIV status. Most of our constituents are indigent,
and many live in rural areas of the state. Our funds are greatly
needed to provide services, and we cannot afford to pay costly
penalties. Because of the confusion surrounding the actual filing
date of our return, we ask that you please remove these penalties.

request.
