NEW YORK JUDGE UPHOLDS GAY TEACHERS RIGHT TO SUE

conduct of teachers' relationships."
"We hope this ruling will encourage many more lesbian and gay employees to stand up for equality in
the workplace," stated Lambda staff attorney Evan Wolfson. "We also hope it will encourage Mayor
Dinkins, who has pledged support for domestic partner benefits, to change the City's policy without
more costly litigation."
Efforts to change such discriminatory employee policies and to recognize the relationships of lesbian
and gay couples have received increased attention in recent years. Last February, San Francisco's law
allowing unmarried partners to register their relationship went into effect. Cities like Berkeley, CA,
Seattle, WA and Ithaca, NY allow some benefits for the partners of unmarried city employees. In New
York City, the Mayor's Executive Order allows paid leave to unmarried city employees for bereavement
or family illness of a domestic partner.
According to David Braff, a lawyer involved with the Gay Teachers' case, the City may not appeal this
preliminary ruling and the case will now proceed towards trial.
