the murder trial of the second of three men accused of
gunning down Charles Eugene Allen. 28 year old David
A. Bucky Smith, with his attorney Jack Love, is pleading

The first of
the three suspects to go to trial -- uee Crow,
who picked* up a bullet in the foot during the shoot-
out -- was found guilty and sentenced to 50-years in
prison May 27th.
Attorney Grady Hight also is in court, representing thethird man charged with murdering Allen.
He asks ~ that
Jimmy Rex Whaley, on the right, be separated from Smith's
case, so that he can be tried by himself, later. Judge
McGregor grants the severance. District Attorney Crouch,
who asked for the death penalty in the eatlier trial,
is asking it again for Bucky Smith. The prosecution1:10
