1980 in Dallas County Criminal Court No. 2.
2) Officers P.R. King and H.K. Sanders were two of the arresting officers
in the organized raid on a Dallas disco bar known as the Village Station
in October 1979. (See Exhibit 'G', No. 79-4036-H, p. 5).
3) The above mentioned defendant Rudy H. was a witness for the defense in
three of the Village Station trials; those of Ron C. (No. 79-4036-H;
28 February 1980), Jim H. (No. 80-18889-H; 21/22 August, 1980) and
Richard S. (No. 80-18891-H/B, 27/28 August 1980).
4) The vice officers who participated in the raid on the Village Station
were very upset when Judge Miller found two defendants 'Not Guilty' in
February 1980, so that Vice Control Division Captain Millican went to
complain to Assistant Dist. Atty. Winfield Scott (Exhibit 'A', pp. 285-
289).
5) Mr. Phillips in open court described defense witnesses at the trial of
Richard S. as a "parade of perverts" (Dallas Morning News, August 29,
1980). These witnesses included the defendant Richard S's mother,
several other hetrosexuals, and Rudy H.
Because of Rudy H's involvement in the judicial exoneration of two of the
Village Station defendants, the DALLAS GAY ALLIANCE contends that Mr. Phillips
determined to go beyond the normal and accepted bounds of prosecutorial ethics
in an attempt to assure his conviction even if it entailed calling for
knowingly groundless testimony from witnesses who were not competent to testify
on Rudy H's reputation in the community for truth and veracity.
Enclosed are Exhibit 'F' (Statement of Facts) and a Dallas Times Herald
report of April 30, 1981, entitled "Vice Officer Admits Testimony Came From
Prosecutors." These documents provide evidence in support of our grievance
against Phillips.
We look forward to receiving your further instructions as to the prosecu-
tion of this grievance.
