from Lyon's district Monday
Both bills allow counties new
regulatory powers over mobile home
parka and wrecking/junk yards. Van
Zandt County Judge Sam Hilliard
explained Wednesday.
Hilliard and the four county com
miasioners drove to Austin Monday
to meet with Lyon, along with
representatives of the other counties
in Lyon's district. Both SB 277 and
SB MS were introduced by Lyon,
and Hilliard noted that Lyon had
requested the meeting to get input
from the commissioners themselves
“We’re definitely in favor of both
bills.” Hilliard said The Van Zandt
County Commissioners have tradi
tionally examined closely any pro-
posed trailer park, and have denied
plats in some cases. SB 277 would
give the county commissioners
authority to regulate the types of
sewage systems used, site selection
and development, Hilliard said.
"We told him that we wanted
teeth in everything," Hilliard said.
The other bill, SB 393, would allow
counties to force wrecking yards and
junk yards to screen the sight of the
yard from the general public, and
would also regulate placement of
new yards, he said.
The commissioners also took the
opportunity to complain about
several items. Hilliard said. "We
had a nice discussion,” he said.
One particularly irksome item
concerned state fees, such as licens-
ing fees. "We don’t think it’s fair for
the legislature to raise the fees col
lected by the county to go to the
state. Hilliard said. “I don’t think
the county needs to be a collection
agency for the state.”
Another item was the disposition
of controlled property, such as pro-
perty seized in a drug raid. “Things
of value, if confiscated, should go
into the county treasury, instead of
that particular department.”
Hilliard said.

ment officials joined in an all-night
manhunt for two burglary and arson
suspects in Smith County and the
border of Van Zandt County Tues
day.
The suspects. Gary Lynn Weaver.
19, of Ben Wheeler, and Rita Hill.
19, of Troup, were arrested Tuesday
for suspicion of burglary and arson
of a Tyler realtor's Chandler ranch
home.
Authorities captured the pair
shortly before 11 a m. Tuesday after
they were tracked with dogs from
the Coffield Prison Unit and by a
Department of Public Safety
helicopter, according to Smith
County officials
The suspects were charged with
the burglary of the Ben Fitzgerald
ranch home north of Chandler and
have signed written confessions ad
mining their involvement, accor-
ding to Henderson County In-
vestigator Rick Rose.
The suspects were spotted by
authorities running along the river
bottom of the Neches River near the
New Harmony Road in Smith Coun-
tv and were arrested without inci-
dent.
The pair, charged with burglary
of a habitation, remained in the
Henderson County Jail Tuesday
night under $10,000 bond each. Ar-
son charges could be forthcoming
pending further investigation of the
case, officials said.

Board eyes tax attorneys
*Nv enforcement action, such as a
drug raid, becomes the property of
the department in charge of the ac-
tion, once the case is closed and the
property declared seised. That ar-
rangement netted the Van Zandt
County Sheriff's Department
$14,000 in cash and a pickup truck
last year, the spoils of a raid on a
Ben Wheeler drug lab.
Hilliard argued that, since the
sheriff s department (for example) is
an arm of the county, and operates
with county funds, any extra funds
resulting from the regular operation
of the department should be put in
to the county treasury. "I'm not say-
ing give it to the commissioners
court or anybody else. Put it in the
treasury and let the whole county
benefit from the interest on it,” he
said.
The commissioners also argued
for a change in the operation of
grand juries. Hilliard said. The pre
sent system does not allow defense
witnesses or testimony in a grand
jury setting, Hilliard said. "Basical-
ly, they only get to hear one side of
the story,” he said "A defendant or
witnesses should be able to meet
with the body with their attorney."
Overall, Hilliard said "We found
that the attitude of most of the other
courts was about like our court;
most want improved government,
and less government overall. You
can have too much government- you
can’t regulate people's lives
CANTON-The Van Zandt
County Appraisal District Board of
Directors gave the go-ahead to try
and whittle the three delinquent tax
attorneys used by the VZCTAD
down to one attorney Thursday, and
also approved the annual audit
report.
"As you know, we inherited all
our delinqent tax attorneys from the
entities that we collect taxes for,"
VZCTAD Chief Appraiser Lady J.
Wright noted. While all three are
nice to work with, she said, all three
use different methods in collecting
delinquent taxes.
"We need one way to do things,"
Mrs. Wright explained "It's becom
ing an administrative nightmare."
In order to consolidate the delin
quent collection work, she said, it
will be necessary to select an at
torney from the three, and then get
the entities contracted with the
other two to cancel their
agreements.
She noted that the school
superintendents would probably
have to get permission from their
school boards before taking any ac-
tion to cancel a contract with their
particular lax attornev.
It s something that we didn t par
ticularly want to do." she said
"However, if we ever go to central
collection and that s something
they're (the Texas Legislature) still
kicking around--we would probably
also go with consolidated tax
statements.. if we can consolidate
the delinquent statements, the more
consolidation, the smoother things
will run. It is possible that the con-
solidation could save the school
districts monev in the long run. she
pointed out.
The board routinely approved the
audit report on the appraisal
district's books for the 1984 fiscal
year The only recommendation
given by auditor James Morgan of
Greenville was that the VZCTADs
bank depository provide S200.000 in
securities above the $100,000 level
insured bv the Federal Deposit In
surance Corporation (FDIC).

the First State Bank of Van. pledged
onh $50,000 in securities above the
FDIC level, which was not sufficient,
the audft report said The VZCTAD
now has Traders State Bank of Can
ton as its depository, and Mrs
Wright reported that bank president
Albert Coleman had agreed to
pledge whatever amount of
securities the VZCTAD requested.

$200,000 in securities above the
FDIC-insured level
In other business during a
45-minute session, the directors
discussed pending tax legislation in
the current Texas Legislative session
with Mrs. Wright.
She also reported that "top priori-
ty" has been placed on finishing the
district's reappraisal of property in
time to send out approximately
75,000 statements by late April or
early May. That will allow time for
meetings with the Appraisal Review
Board and changes before July 25,
when certified tax rolls must be pro-
vided to the 15 taxing entities in the
county.
