and livihg and shall be a distance of at least three hundred
feet from any public place or building where people congregate
for business or pleasure; provided, that at no time can more
than two head of the above mentioned livestock be kept by
any person in any enclosure within the city. This provision
shall not apply to livestock on exhibit at a livestock fair
or exhibited for a temporary period of time. (Ordf No. 146,
§3.)
Sec.- 5-2; Certain animal pen, etc., a nuisance.
..Any. barii, pen, lot or enclosure in the city limits where
horses, mules', jacks, jennies, cows, cattle, sheep or goats or
similair animals are kept which barn, pen, lot, or other enclo-
sure i$ kept, maintained, are permitted to be unclean or un-
sanitary in any Of the f ollowing respects:
(a) A place where manure, or offal is permitted to accu-
mulate;
(b) A place that creates obnoxious smells or odors;
(c) A place where the water or waste from the same
drains upon any street, sidewalk or alley of the city or upon
the property of any adjoining owner;
(d) A place that attracts flies or other obnoxious in-
; sects; •
is hereby declared to be a public nuisance and a menace and
injurious to the public health, welfare, and comfort.
It shall be unlawful for any person as owner, lessee, or
occupant to maintain or to permit to be maintained, a nui-
sance as above defined; upon any property or premises under
his ownership or control. (Ord. No. 146, §§ 1,2.)
Sec. 5*3. Keeping swine prohibited.
It shall be unlawful for any person to keep, cause to be
kept, for any purpose Whatever, any swine within the city
limits.

Article II. Dogs.*
Sec. 5-4. Duties generally Of chief of police And humane
f . officer. • ’
. • The Chief of police:shall have collected under his supervision
all dog taxes, and he may employ a special officer to be known
and designated as the humane officer, whose duty it shall be

of police, shall be. responsible to the. city for all monies col-

manager and. shall pay over to the city manager all money so
collected, at least Once a month. (Ord. No. 236, § 2.)
Sec. 5-5. Dog tax.
There is hereby levied and assessed upon each dog kept or
owned within the city an annual tax of twenty-five cents on
each dog which tax is to be due and payable on the tenth day
of April, each year. It is hereby made the duty of the owner
or keeper of any dog to pay over to the chief of police or his
duly authorized agent the tax on or before the tenth day of
April each year. (Ord! No. 236, § 1.)
Sec.. 5-6. Dog tag and license.
Upon the.payment of the dog tax, the chief of police or his
duly authorized agent shall furnish the-owner or keeper of the
dog with a tag on'which, is stamped the number of registra-
tion with the'year for which tax is paid, which tag the owner
or keeper shall attach to a collar securely fastened around the
neck of sueh dog. In no event shall the^chief of police or his
duly authorized agent issue a license tag to any owner or
keeper of a dog unless and until such owner or keeper shall
furnish a vaccination certificate issued by a veterinarian
stating that such dog or dogs have been vaccinated against
rabies by him.
Whenever any person has complied with the provisions of
this article and the dog tag is lost or otherwise destroyed, it
shall be the duty of the owner or keeper of such dog to pro-
cure another tag from the chief of police by paying the value
of such tag and all costs that may have accrued as hereinafter
provided. (Ord. No. 236, §§ 3, 4.)
Sec. 5-7. Rabies vaccination.
All dogs within the city are hereby required to be vacci-
nated against rabies by a veterinarian on or before April 10,
of each year. Every veterinarian who vaccinates such dog
shall collect his fee for same from the owner of the dog and

shall issue a certificate of vaccination to such owner, stating
the name of the owner, a brief description of the dog, the date
of vaccination and the fee collected by him for the same;
provided, however, that the fee charged by such veterinarian
for such vaccination certificate shall not in any case exceed
the sum of three dollars. (Ord. No. 236, § 4.)

No person shall allow any dog owned or controlled by him
to run at large off the premises of the owner or person in
. control of such dog.

Sec. 5-8. Impoundment of dogs running at large; notice;
redemption; failure to redeem.
It shall be the duty of the chief of police or his authorized
agent to capture and impound in a pen to bfe provided by the
city for that purpose, and called the animal shelter, any dog
found running at large within the city as provided for under
-the terms of this article. If such dog is not redeemed and
reclaimed and taken from the animal shelter within the time
required under the provisions of this article, then the chief of
police or his duly authorized agent, shall destroy such dog.

Sec. 5-9, Disposition of rabid or vicious dogs.
The chief of police and any policeman shall have the right
to shoot or destroy any rabid dog, or any dog in the streets
which shall manifest a disposition to bite. In the event any
dog in the city shall bite any person or shall attack any per-
son, then, and in that event, the chief of police and any police-
man shall iriipound such dog in the animal shelter of the city
for a period of at least ten days for observation for rabies;
(Ord. No. 236, § 7.)
