H.B. No. 967
1 (b) The board shall appoint the board of directors of each
2 nonprofit corporation created under this section. A board member
3 is not required to reside in the authority.
4 (c) A board member or employee of the authority may
5 simultaneously serve as a member of the board of directors of a
6 nonprofit corporation. A person serving as a board member of the
7 authority and of a nonprofit corporation created under this section
8 may participate in all votes relating to the business of the
9 authority or the corporation.
10 (d) The nonprofit corporation may not exercise the power of
11 eminent domain.
12 (e) A nonprofit corporation created under this section is
13 subject to Chapters 551 and 552, Government Code.
14 SECTION 3. This Act takes effect September 1, 2017.3
