CROSBY- A decision by the
Texas Air Control Board on a re-
quest for a special permit for a
I pilot plant tn Crosby that would
I manufacture a chemical used in
a household commercial product
is expected within two weeks
according to a TACB hearing ex
aminer,
The examiner Bill Eh ret rul
ed Tuesday at a prehearing con
ference that there will be no
future case hearings on the ap
plication by the Pennwalt
Corp s Luctdiol Division to build
a pilot plant for the production of
dodecanediotc peroxide
After a reading of disputed
issues (a formality by the
TACB i, concerning the applica-
tion by Pepnwalt. a motion was
made by David Beck of
Fuibright and Jaworski the law
firm representing Pennwalt at
the hearing, to dismiss further
hearings on the application
Time is absolutely critical. *
Beck said
According to Jim White an en '
vtronmentai engineer for Penn
wait, the project is already
behind by two months because of
delays in the processing of an
original application for an ex
emption with the TACB. which
was never denied nor granted
Because the fACB required
Pennwalt to -reapply for a
special perms! the protect could
not begin on schedule White-
said ' ,
Preliminary construction has
already taken place on the new
facility White said About 5
percent of it s already buijt
The construction is a matter of
converting existing buildings
rather than building new ones
White said
Construction and conversion
renovations had to be . halted
when.-the- exemption did not
come through White said
According fr T ACB attorney
Priscilla J Faizone the pilot
plant proposed by Pennw alt did
not qualify for a consideration to
be exempt from certain stan-
dards set up by the TACB
However Ms Falzone said
Pennwalt did qualify for applica-
tion for a special permit under
TACB regulations Basically a
special permit is one for a
smaller type facility, the said •
While almost 25 Crosby
citizens attended Tuesday s con-
ference. none had a specific case
to present Those citizens in at
tendance were there to get some,
answers about what kind /
monitoring procedures and
regulations TACB will put on the
pilot plant
