Was Convicted of Second Degree
Murder and Given Fifty-
one Years
Austin. May 30.—The court or
criminal appeals reversed and re-
manded the case o! J. W. Johnson
from Dallas. This was the second
appeal. Johnson was given fifty-
one years in the penitentiary in con-
nection with the murder of Devi
McGuffey having been convicted of
murder in the second degree.
The court reversed the case be-
cause the dying declaration of the
deceased was allowed to bo intro-
duced as testimony; also on the
grounds that the state was permit-
ted to lay a predicate of the testl-
' mony of appellant’s wife before the
grand jury and thus forcing her to
testify against her husband which
is contrary to law.
