correctly admitted in evidence a portion of a
sworn bill in equity brought by plaintiff against
Houston in the United States court for the pur-
pose of rescinding the contract here sued upon
because McAnulty was not bound by It etc We
think this portion of the bill sworn to by
plaintiffs was properly admitted as proof of ad-
mission of the fact that McAnulty was not liable
But appellant was also properlv permitted to
explain the matters in said pleading Wharton
on Ev vol 1 p 833 Mosty exhibited in his
depositions a photographic copy of the duplicate
of the original contract -which bore McAnnltys
name as one of the witnesses McAnulty had
denied knowledge of the existence of tho con-
tract until long after the execution McAnulty
denied the signature being his own Plaintiffs
to contradict this offered a memorandum on the
original contract without signature or proof of
nxecutiou of said memorandum to the effect
that McAnulty was a witness to the duplicate
contract This was properly excluded In this
connection it would have been error If the court
had admitted tho mere opinions of witnesses to
testify as experts as to the genuineness of Mc
Annltys signature And farther the photo-
graphic copy although admitted without objec-
tion could not have been used for the purpose

C J In this salt by appellants the heirs of
Thomas Logan for a strip of land of Thomas
Logans league the defendants offered In evi-
dence a paper purporting to be the will of Thos
Logan who died m 1815 but nothing was offered
to show that such will had been admitted to pro-
bate This will was offered for the purpose of
showing that the executor under it had a right
to establish the lino as he did which brings the
strip here in controversy The objection to the
introduction of the will should have been sus-
tained as the decree probating it had not been
produced nor its destruction had been proved

not have authorized the executor to run a lino
different from that in the grant as that would
have involved the power to give away the estate

if without authority tho subsequent recogni-
tion of that line as the true line by the heirs with
a knowledge of the facts ought to bind them
if the recognition was such as wonld bind them
bad the lino been recognized by their ancestor
bat not by him established by parol agreement
The record does not show anv such recognition
unless it be on part of William Logan There
was no parol agreement establishing the line
of the Logan grant when defendants say it
was established and in the absence of this there
must have been a recognized line with reference
to which the plaintiffs have acted or in which
they have acquiesced But nono of the boils
excepting probably William Logan had knowl-
edge that the executor had established a line
and they cannot be held to have acqniesced in
that of which they had no knowledge The
charge of the court on the establishment of tho
line by the executor and acquiescence in it by
the heirs was improper as to all the heirs ex-
cepting William Logan That charge was also
too general in that it did not define acquiescence

New Yobk May 24 The announcement of
the terms of the Atchisons purchase of the St
Louis and San Francisco this morning brought
out a lot of selling orders in securities of corpo-
rations concerned and from buUs who wished
tQ realize profits Traders took advantage of
this and raided the market The fact that to
day was holiday in London aided them somewhat
because London has been buying Atchison for
the past few days Atchison and sugar certifi-
cates suffered most from the raid Dealing in
the latter was feverish and exciting and bears
forced prices down 2t points in a moment and
314 points altogether St Paul was stifily sup-
ported by the bulls Distillers and cattle feed-
ers company securities were remarkably strong
and prices were up in grasshopper like bounds
The price of spirits of alcohol was reported to
have advanced 7 cents per gallon There were
also unauthenticated reports that distillers and
cattle feeders and citizens and gas of Brooklyn
will pay increased dividends Tho market
graaualfy Improved as they went on the report
having gone abroad that the bank statement
would show considerable increase In surplus
reserves and when It appeared showing on un-
expectedly large increase or nearly l50i000
prices jumped up and the market closed active
end lusty at nearly the best prices of the day
Atchison reported an increase of earnings of
104970 for the second week in May and of
S0026 for two weeks in May
For the convenience of readers we repeat the
terms of the Atchison purchase of the St Louis
and San Francisco The capital stocJr of the
St Louis and San Francisco company consists
of 4MX0 shares of first preferred 10000 shares
of preferred and 153000 shares of common of
which 3G47 shares arc held in the treasury In
the purchase concluded first preferred stock
is not disturbed and holders of pre-
ferred stock receive one and three eighths
shares of the Atchison companys stock
for one share of the St Louis and San Fran-
cisco railway companvs stock and holders of
common stock receive three quarters of one
share of Atchison stock for one share of St
Louis and San Fracisco railway company Tho
Atchison company has issued new stock worth
at par value 270COQ0O out of this 5262i5175
par will have been delivered for the Si Louis
and San Francisco companys stock and

Up to the lime it began to rain late this after-
noon business was all that the merchants could
desire for there were increased crowds upon the
streets and in the various business houses vis-
itors and city people to make trade quite lively
The grocers and family supply dealers had a
great rush to day to supply the wants of their
customers In reviewing the general markets in
this line it Is noted that vegetables poultry
eggs ouiter etc usually in light supply on
Saturday are all In good supply to day and In
vuuscquence prices are generally lower
the revision

The weeks decrease In avaUablo wheat stocks
at nearly 100 points of accumulation east of the
Rocky mountains as reported to Bradstreets
onMaylOwas 1133863 bushels about the aver
age weekly decline for the first quarter of the
current calendar year If the decrease each
week averages about 1200000 busn
els between May 10 and the close of the
cereal year the outlook is for an aggre-
gate stock of available wheat on July 1 next
amounting to 23500000 bushels as compared
with 203il000 bushels on July 1 1US9 reported
to this journal as compared with materially
larger aggregates on like dates in four preceding
years and as contrasted with about the same
totals on July 1 in 18S4 and 1S33 respectively The
outlook now is that oar total exports of wheat
and Hour as wheal for the twelve months end-
ing June 30 next will amount to about 110000
000 bushels as compared with 90000000 bushels
in the preceding twelve months an increase of
201100000 bushels this year
These considerations suggest an Interesting
statistical comparison as to wheat stocks which
may as well be offered for what it is worth
According to accepted versions of official re-
ports of the wheat crops of 1SS9 and 1S18 the
former exceeded the latter by about 73000000
bushels It therefore becomes interesting to
trace if possible the excess of wheat pioduced
last year in tho light of existing informa-
tion As pointed oat in the foregoing
there is a probability that by July 1
we shall have exported 20000000 bushels
more wheat this year than last and as may be
perceived by an examination of our reports of
available stocks on both coasts the probability
is for an excess of aDoat 6000000 bushels avail-
able stock July 1 1890 as compared with a total
on a like date lSt9 Then if 8000000 bushels
be allowed for increased home consumption for
the current cereal year as compared with the
year preceding we arrive at an aggregate of 35
000000 bushels this year more than was consumed

xms points to about 33000000 bushels of tue
735001000 produced in of 16S8 not
consumed at home exported or to be found in
available stocks a principal points of shipment
which if the government and our own reports
are approximately accurate must be contrasted
with the 16000000 bushels both in and out of
farmers hands on July 1 1SS9 Wo are
therefore threatened apparently with a stock
of wheat visibloand invisible both coasts
on July 1 of about 62000000 bushels as com-
pared with 37000000 bushels carried over vis-
ible and invisible July 1 1883
This is not a ball showing certainly and is
not one calculated to sustain dollar wheat The
only thing to he borne in mind in connection
with it is that it is based principally upon the
last two official reports of wheat crops in tha
United States If they are even approximately
accurate the calculation made above cannot be
very far out of the way We offer it simply be-
cause we know of no one else among either offi-
cial or unofficial reporters of wheat statistics
who has official data as to approximately total
stocks and exports down to date to render pos-
sible such a calculation as to the probable out-
come with official crop reports as a basis
