In 1870 Austin Sims a young man
who lived in the Perry neighborhood
was supposed to have murdered James
Mellon Officers and citizens united in
hunting for him but ho eluded them
A body was found in some brush near
where Sims was supposed to be and
for a time it was believed he had been
killed bv pursuers However after the
excitement had in a measure subsided
and months after all pursuit had been
abandoned Austin returned and sur-
rendered himself to the authorities
He was indicated and in 1S7K was tried
found guilty and sentenced to thirtj
five years imprisonment A new trial was
gtanted but owing to the sickness of
a main witness for tho prosecution tho
state lias asked for two continuances
This entitles the defendant to bail
and yesterday Austins sister Mrs
Mary Hansford nnd his
father Elisha Sims appear-
ed before the court and
made a showing satisfactory to
Judge Uiiues nnd in the further con-
sideration of the precarious health of
the defendant the sureties were ac-
cepted and Austin Sims was released
from custody on the charge of mur-
der the bond being fixed at 51500
In 1S77 Austin was also indicted on
three charges theft of a cow altering
brands on a gelding and altering
brands on a yearling Mrs Mary
Hansford was accepted as surety in
the sum of 8100 on each of the three
charges and Austin Sims walked out
of the courtroom a temporarily frco
I man after remaining m the county
jail tw years and ten months His
father anil mother sister and beveral
friends were present and tho meeting
was a gladone Mary Hansford is the
widow of D L Hansford who was
found hanging to a tree in this county
in 1875 About two years ago she
married Phil Kirkpatrick but at the
present term of court obtained a
divorce on the ground of cruelty She
has clung to her brother through all
his troubles and has made attempts
at every term of court to secure
his release on her surety but tho
amount fixed by Judge Alexander
3500 was beyond her means al-
though she owns in her own right a
cultivated farm in Hell county of two
hundred acres valued at 15 per acre
besides forty acres of good timberland
Sho also has a homestead of two hun-
dred and forty acres in McLennan
county At tho time of his arrest Aus-
tin owned a considerable number of
cattle but they strayed away and now
he has nothing His father Elisha
Sims owns a valuable homestead and
considerable stock but his sister fur-
nished tho financial security Mary
Hansford is still a young and good
looking woman Her devotion to an
unfortunate brother is indeed com-
mendable and under the circum-
stances the accomplishment of her de-
sires will doubtless be approved by the
public Austin some time ago was at-
tacked with mumps and a not uncom-
mon termination of the attack
has made very notable in-
roads upon his health and this fact led
Judge Klines to reduce the security to
an amount which could be met by the
relatives taken in conjunction with
the fact that the state has been the
cause of delay in the trial The total
amout fixed formerly including the
three minor charges was JV11

For some hours yesterday morning
this immediate section was visited by
the heaviest rainfall of the past three
years Rain fell in sheets for five
hours and every watercourse was

between Waco and Cranfall we learn
that the rain did not extend more than
twenty miles to the west and northwest
of the city but within that radius an
immense volume of water fell filling
tho South Bosque and Hug creek the
former raising eight feet Fences all
along the course of these two stieams
even where there were no ratines were
washed away and a great mam
bridges and culverts are gone
Tho dnei was foreen to
wait several hours for the Hood to sub-
side so he could ford the lo < qiie It
fell live feet in the time he wutedand
has now subsided

that during his
trips extending over
nearly three years there has been no
fall of rain like that of yesterday
Tho Brazos rose about five feet vester
day and tloated an extraordinary
amount ot driftwood fences etc
During tho afternoon a small bridge
was noticed as it passed under the sus-
pension bridge and as it sailed majes
tically oceanward it heralded to all be
holders that John Sleeper was the boss
boot and shoe man of Waco The new
culvert on Washington and Twelfth
streets on the street railway having
too small capacity for the water was
washed away A car was caught on
tho south side anil the driver led hio
mule around turned the car loosu on a
down grade and it went across the
risky place at a rattling pace running
suveral blocks to tho top of the hill
before stopping The culvert will be
replaced in several days and tho cars
will run as usual

in her gifted daughter Mrs Ruth Car-

The nbovo is quite a high compli-
ment to the Waco authoress We have
always been under the impression
however that Ruth Carter was a ficti-
tious name What say the Waco pa-
pers on tho subject Fairfield Re-
corder
The serial now being published in
the CourierJournal is entitled A
Heart sParrallax or a Story of South-
ern Life Since the War The auth-
oress is Ruth Carter tho same who
gave Error to southern literature
Our contemporary at Fairfield is right
on one point Ruth Carter is a uom
dc plume but the lady is a resident of
Waco and our people are very proud of
her literary attainments no less than
her social graces We do not know
that we have liberty to publish her
name but her husband is now a well
known lawyer practicing his profession
in this city and he won as deserved
reputation in the cause of the south
starting in as a lieutenant of artillery
and coming out with a brigadiers
stars as his wife is now winning m
the cause of literature Ruth Carter
is an exemplary domestic woman too
The mother of children she has never
allowed her literary tastes to infringe
upon thejdaties of everyday home life
which is more than can be said for
every wife and mother gifted with
literary attainments

A certain old negro was charged with
gambling in Justice Evans court but
he stoutly denied his guilt alleging
that he was a strict churchmember
and not addicted to bad habits Day
before yesterday however he paid 22
the fine say ing he had rather pay the
money than be troubled with the mat-
ter although he was perfectly inno-
cent It transpired however thai the
colored brother admitted to playing
cards with another negro and winning
a cow and calf which arc now in his
possession The cow is worth the
money but the county and not the vic-
timized owner gets the purchase

More interest was displayed in the
proceeding of the district court yes-
terday than has been shown for several
weeks The first case called was that
of J C Mills for disposition of mort-
gaged property which was dismissed
Green Sweat for rape was also ills
missed Fayette Buchanan a colored
youth was sentenced to three years
imprisonment for stealing a suit of
clothes from Virgil Melv mght James

dismissed in two cases This w the
last of the eases growing out of the
trouble which occurred near Stnutield

death of several persons

Kwmisek learns that the returns al-
ready in give a majority of one hundred
and fourteen for prohibition with four
precincts to hear fromwhieh will likely
increase the majority Only two pre
cincts in the county the Morgan ami

jority against prohibition Our cor-
respondent also says that poor connec-
tion at Morgan since the allrail mail
schedule went into effect finises mails
