testimony in tho case when ho dis-
missed the caso ngniust Mr. Frelberc.
The evidence was conclusive that less
than llvo gallons of liquor was con-
tained iu each keg sold and tho law
will hold anyone guiltless who sells
four gallons three and one-half quarts
three gills and a thimble full. Mr.
Freiberg was congratulated on his ac-

Fannto Baldwin who shot 12. J. Bald-
win known ns "Lucky" Duldwin in
this city yesterday claims to bo n
cousin of "Lucky" ami that Mr. Bald-
will had wronged her and cast her
ndrift. Mr. Bnldwin denies tho rc-
lntionehlp nud nays the (Irst time he
saw her was n few days ago when she
applied to him for money to pay for
her life lnsumneo Hiving she would
commit suicide and thus bequeath a
fortunu to her mother and sister.
She gives ns reasons for
the shooting: I camo from
Oregon where my father and
other relatives nre. My mother died
some two or three years ago. Hero I
met Baldwin who is a cousin of mine
Ho gave men position as teacher on
his ranch nt Santa Anna. I after ward
came to this city where h succeeded
in accomplishing my ruin. Some
months ago 1 went to Oregon but
again returned here nud sought Mr.
Baldwin for assistance. I have been
stopplug at the Buss House and for
several weeks have vainly endeavored
to H ml employment. A few days ago
being again refused assistance 1 de-
termined to do something. I should
have killed hhu long ago. I should
have killed hlniin Los Angeles county
He did not seduce me he used force
and theru is whero I made a mistake.
1 should have spoken and vindicated
my honor then Instead of crying My-
self Insane lshothlni where 1 In-
tended to shoot him. I never missed
n mark In my life. I am a good shot.
I could have killed him If 1 had
wanted to and I ought to have killed
him. Ho has ruined mo and driven
mo cra.y. If 1 had wanted to kill
him I could have come up behind him
and put my pistol to his back. The
sympathy of the public? Is all with
the girl. A man who knew her in
Oiegon says that she graduated from
Forest Grove University in that state
and was regarded as a quiet and highly
cultured lady. Her relatives are re
spectable nud sho had never doue
anything improper. A day or two
ago she called upon this man and told
him that she had been on a visit homo
for medical treatment. On being
asked what ailed her sho icplled: "I
am out of my head" at the same time
placing her hand upon her breast.
She said she was not going to live long
and Intimated suicide. Mr. Baldwin
earned thenlckname"lucky" from the
manner in which he acquired his
great wealth. Twenty years ago he
Mas an honest miner delving into the
bowels of tho Conistock for Ills dally
bread. He with a party of friends
staked out a claim and settled down
on it 1th nothing to speak of but faith
to work on. Nobody consldeied the
claim worth a second thought but
Baldwin kept on sinking his shaft
and wokc up one morning with mil-
lions In sight. Then the miners culled
him "Lucky" Daldwin. He has had
a remarkable career. Going to San
Francisco ho associated himself with
such men as Senator Sharon Ralston
of the California bank. Flood and
O'Brien of the Nevada bank and bet-
tor known as tho bonanza kings Lath-
am and others. Being a lgucious and
above all "lucky" he having plenty
of funds at command he soon made
for himself a name on California
street whero the old stock exchange
stood. His operations were as bold as
those of Keene's in luter years and It
was not long before ho was at dagger's
point with tiio boiiiui.n firm but with
Ills universal good luck generally
worsted them. His fortune a few
years ago was estimated at $20000000.
About lour years ago he built the
JJaldwin Hotel and opera house the
finest hotel west of tho Mississippi
although much smaller than the
Palace. Tom Moguirc tho veteian
California manager has always
managed the opera house although
Baldwin has sunk vast Hums in keep-
ing It up. Ho put up petroleum gas-
works lor the exclusive use of his hotel
and theatre. It blew up and killed
one or two nnd wounded others. He
built it again. It tcrok him months to
set thencrmit from theuuthoritics.and
he built it in tho face of tho protests of
tho cntiie population it was nt his
hotel that Mr. Baldwin met mid mar-
ried his second wife a beautiful woman
who lived two years only. "Lucky"
Baldwin's career since his acqui-
sition of wealth has been as
checkered and eventful as In the foity-
iilnes. His daughter a lovely girl ran
away fioin her first husband Snyder
and he procured a divorce from her.
She subsequently married Iludd
Doblo tho noted horse-trainer but
sho did not mend her ways and Doblc
separated lrom her. Soon nfterhis big
lio'el was complit d JJaldwin was
sued by a young woman Vianic Mc-
Corinnck whom ho had employed to
sew on tapestries for $10000 for breach
of promise and seduction.
