committed a great blonder In
rejecting the liberal proposT-'
tions of the republicans for an
adjustment .of. the. anomalous

seem tolhcuseless to attempt
to shift any responsibility upon
Mr. David Davis he having ex-
pressed thcopinion before the
meeting of the senate that the
republicans were entitled to the
organization of the senate. It
would seem that while Mr.
Davis had acted with the demo-
crats'prenously he was under
to moral obligation to do
so in the future. It is not
apparent that Mr. Davis has
either acted irt bad faith or stul-
tified himself. He seems to
have seen a trifle further than
the democratic senators did in
caucus. "Mahdne had long
since allied himself on the re-
publican side of the house Mr.
Davis' vote without that of Ma-
hone or some regular republi-
can would not have given the
democrats a majority; Accord-
ing to the News the democrats
staked all on the bare chance
thafsenatpr Davis would com-
mit a magnanimous act of self-
abnegation and throw four hun-
dred poundsi-avoirdupois and a
vote. in the scale-to sustain the
-action of the caucus and humor
the whim of thesenator from
Delaware. The position of Mr.
Davis is his own concern and
cannot relieve the dcrnocrats
;from the. charge o"f unwisdom
and the' commission of a blun-
der for which there can be little
.excuse.

does not approve; of sending

be any reasons for the defeat of
Coke they should be pointed
out j that Coke has been faith-
ful to his trust ;that he is class-
ed Tunong the oldest represen-
tatives of the south in the sen
ate ; Is clear headed conserva-
tive and reliable full of energy
-and zeal and devoted to the in
terests of Texas. Roberts and
his-perSonal friends think that
he is Texas.

If there is any justification
for lynch law it can certainly
be found In the swift and con-
dign punishment meted out to
the perpetrators of the horrible
outrage in Panola county and
referred to elsewhere. When
such horrid crimes are commit-
ted people become so outraged
and incensed that nothing short
of immediate punishment is
satisfactory; it would be al-
most a sin of itself to allow
such monsters in human shape
to encumber the earth when a
little bit of rope or a Tew cents
worth of powder and shot will
make an end of them and save
all the trouble and annoyance
of a tedious and expensive trial
as Well as running the risk of
the uncertaintyof the law. In
urgent cases like the one under
consideration lynch law is sure
certain and speedy and further
the villians being almost caught
in the act there is no room to
doubt their guilt. In the ab-
stract the moral effect of lynch-
ing does not amount to any
thing but it may have the ef
fect of deterring others Irom
committing heinous crimes.
Lynch. law is bad; itshould not
be resorted to exceptin the-most
extrem cases and the one un
der consideration seems to be
such. After the fiends have
been lynched and the country
ridded of them it is a good
time to hope that nothing may
occur to make a recourse to it
almost an absolute necessity.
The Late Election.
The university vote was
counted on Monday by the sec-
retary of state. The fjrst count-
ing up shows a total vote for
division of 38135 ; against di-
vision 18298. Austin for en-
tire university 14621 ; Austin
for main university 7156; Waco
for main university 3706. Tyler
for entire university 547; for
main university 18428. The
total vote polled was 66762
divided as follows : Austin 30-
835; Waco 9857; Tyler 18-
970; Lampasas 2822; Thorp
Springs 3181; Caddo 581;
scattering 419. According to
the views of the governor and
secretary of state. Austin's
vote for the enure and main ad--ded
together and the sum be-
ing above one-third. of the total
vote that place will be declared
elected ror the medical de-
partment Galveston received
29734; Houston 1274s and
there were cast scattering 1307
votes-
Both amendments to the con-
stitution were voted down by a
large majority.
Some persons fear there will
be a controversy in the courts
over the matter
The country in the neighbor-
hood of Waco is infested with"
horse thieves. The Examiner
thinks that an organized band
of thieves are operating in that
vicinity. Bands of horse
thieves exist in nearly every
portion of the state and it is
more than likely that they all
know and help each other.
Hardly a week passes that a
horse is not stolen in this coun-
ty ; not one-half of the thefts
are ever made public.
The coroner's jury in the
case of the persons killed by
the burning of the cotton mill
at Philadelphia returned a ver-
dict charging criminal neglect
on the' owner of the mill in not
providing fire escapes and
blaming the city of Philadel-
phia for not enforcing the law
relative to fire escapes.

On the 22d of September
three men robbed the Iron
Mountain train in Arkansas
and by the 38th all three had
been arrested tried convicted
sentenced and sent to the peni-
tentiary for seventy years each.
This is speedy work for Arkan-
sas and could well be emulated
fcy other states.

Governor Roberts has named

Navasota's city council has
passed an ordinance banishing

Henry Chatham of Bell-
ville was struck on the head
with a piece of timber by a man
named Pat Dyer at Roscnbertr
Junction last Monday and
killed. Dyerwas jailed at Rich-

Texas and St Louis narrow-
gauge and the Missouri and Ar-
kansas roads have consohdased.
