cordial approbation of all. Tho play
is a story of Irish lifo and the rich
broguo of the Colt prevados it lrom
opening to close. In this particular
tho players one and all sustained
their parts most excollently. As Col-
leen Bawn tho lovely peasant girl
Miss Julia Robortson displayed raro
dramatic talent while not a whit
loss excellout was Miss Holuoman
whoso splendid noting in tho closing
scene of tho lastaot would have douo
credit to a professional. Miss Katie
Rlsher as Anne Chute exhibited a
peculiar morit which drow forth tho
generous applause of the audience.
The male characters were equally
meritorious and they havoachloved
for themselves an enviable fame on
the amateur stage.
The performance was given for the
benefit of the Philo Literary club and
a neat sum was realized. The News
hopes to have the pleasure of seeing
the Phllo Dramatics on the stage
again at no distant date.
The music rendored by tho Orches-
tra uudor tho leadership of Prof.
Beoker was most chnriulnar and ar
tistic.
The "Bandit King" holds tho
boards to-night and is worth seeing.

THE WILSON CASE.
Mayor Hinohman's DeolBlon on
Sunday Law Violation.
The mayor delivered his decision
yesterday in the case of the City vs.
J. T. Wilson charged under article
466 with keeping his saloon door opon
on Sunday. Tho decision is a good
one and is given in full as follows :
The defendant is chanre bv affida
vit with keeping the doors of his
saloon open on Sunday tho Oth day
of September 1888.
It is claimed by the city that de-
fondant violated Art. No. 460 of the
digest of ordinances.
Defendant claims and proves that
ho has a restaurant in the samo
building with his saloon and tho en-
trance from the street the samo that
ne Kept open ono ot tno iront uoors
to enable customers durlner the dav to
havo access to his restaurant that
his saloon aud bar was shut off com-
pletely by a canvass curtain with a
sign printed thereon to tho effect
mat tno oar was cioseu.
Defendant also exhibited his license
from the city to keep a rostaurant.
Defendant also contended that Art.
466 of the digest of ordinances was in
contravention of Art. 391 of the re
vised statues and charter of the citv.

Art. 186 and 186 A. of the nonal codo.

As the defence In this caso raised a
grave question as to the constitution'

mature jud well advised delibera-

and in a very learned argument tho

insisted on while the defence was
represented by Wm. M. Flournoy
who In an elaborato and eloquent ar
gument backed by authority Insisted
on tho want of authority In tho city
council to pass tho ordinance in ques-
tion. My only objeot is to disoharge to
tholAeat of-my ability the trust con-
fided In me by the citizens of Waco.
Had defendant been charged with
selling Intoxicating liquors on Sun-
day and had he been charged with
keeping his saloon open ou Sunday
for the purpose of selling intoxicat-
ing liquors and either charge sus-
tained by proof then there could
arise no question of his liability under
tiio state law or tho charter" of the
city or its ordinance.
Unde the chargo and proof as stat-
ed above I am of tho opinion that de-
fendant has fullvdlsprovod any inten-
tion to violate the ordinance and did
not violato it in this case and acquit
him of this charge.
Defendant having raised the ques-
tion of tho constitutionality of the or-
dinance after u groat deal of thought
and examination of the points pre-
sented by;argumont and brief of coun-
sel I am of tho opinion that Art. 460
of tho digest of ordinances is not war-
ranted by Art. 391 of tho olmrter and
is in contravontion of Arts. 180 and
186 A of tho penal codo.
Art. 391 of rovisod statutes may or
may not bo reconciled with tho pro-
visions of Arts. 186 und 186 A of the
penal codo of this howovor I do not
fool Itireoosaary or pertinent to glvo
my vlowsj but I think thoro can bo
no question to any thinking or un-
prejudiced mind that the article of
tho digest under which defendant is
chajrgedis In contravention of the
lawsofthostato as to tho kooplng
open fjh doors and the city coun-
cil passed tho samo without authority.
