MOTIONS FOR NEW
TRIALS OVERRULED
Motions of the defendants asking new
trials were overruled in county court
!M3onday in the cases of W. A. Custer
against the Pullman company in which
the plaintiff obtained judgment for $900
and the El Paso Lumber company which
obtained judgment on account for 218
against Lulu JBrowning. The defendants
gave notice of appeal in both cases.
In the Custer case the plaintiff asked
judgment for $999 damages alleging
that he and three companions suffered
mental anguish as "a result of being
forced to ride in a chair car between El
Paso and Benspn on the Southern Pacific.
The men had Pullman car tickets but
the Pullman conductor refused to allow
them to ride because each had a small
bundle of blankets. The men are miners.
TWO JURIES FAIL
TO REACH VERDICTS
Unable to apcree the jury sitting in
the case of Aniseto Medino in the 34th
district court was discharged bv judge
Harper Saturday afternoon. Medino
cmen Pnla-
cias. Medmo alleged an alibi producing
witnesses who swore he was at home phe
night the assault i alleged to have oc-
curred. In the suit of J H. Riley against TT.
F. Duval iwhich was heard in county
court last week the jury .was also dis-
charged late Saturday afternoon. The
plaintiff asked judgment for $528
alleging damage to his household goods
on acoucnt of an alleged leaking roof.
RICHARDS RECEIVERSHIP
CASE SET FOR DEC. 12.
In the case of A. H. Richards vs.
Richards Jewelry company the de-
fendant's demurrer to the petition for
a receiver was over-ruled and the case
set for hearing in the 34th district
court on December 12. It is understood
that if the First National bank pays
the outstanding indebtedness of about
$2000 it will obviate the .necessity for
appointing a receiver. .
VIOLATION OF QUARANTINE
REGULATIONS IS ALLEGED
Charged with violating the quarantine
regulations W. W. Hunt was on Monday
arrested and put under a bond of $50 for
trial. It is charged that Hunt left the
pest house ithout leave about a month
ago when he was being held under sus-
picion of having been exposed to small-
pox. NOVEMBER TERM OF THE
COUNTY COURT ADJOURNS
The Xovember term of 'county court
was adjourned Monday afternoon fol-
lowing a day devoted to the hearing of
motions asking for new' trials. The
past term has resulted in the dt?position
of a number of actions.

The American National bank will be
in its new seven story home before the
end of the week. The verdi-Antique
fixtures or the bank have been In-
stalled the decorations have been com-
pleted and the furniture is now being
unpacked for the new bank quarters.
The officials of the bank expect to be
doing business in the new American Na-
tional building by Saturday.

on the Arizona and Boulevard lines.

terial steel frames bars and doors
have arrived for the jail at Fort Da-
vis. Several carloads of rails and build-
ing supplies for the San Esteban dam
have arrived.
George Shannon has bought several
lots on the northeast hill and will
build some rent houses.
Mrs. James Shannon entertained the
very young set Saturday afternoon at
a party complimentary to her little
son Charlie the occasion being the
anniversary of his birthday.
The young men and women of Mar-
fa's social set are planning a big mas-
querade ball during the holidays.
The Episcopal church has arranged
an entertainment .for the children of
the Sunday school to take place Christ-
mas eve.
Mr. and Mrs. John Livingston and
Mr. and Mrs. Arthur Mitchell have re-
turned from a hunting trip bringing
in a fine bag of quail and some ven-
ison. They went in their cars out to
the Ben Pruitt ranch 53 miles from
Marfa and were gone three daj-s and
nights.
PHOENIX EXPECTS TO GET
.MINING CONGRESS NEXT TIME
Phoenix Ariz. Dec. o. It is pos-
sible that the American Mining con-
gress will come to this city in 1911.
Douglas Is seeking the convention but
it is said that city is too small.
A. R. Taylor a real estate dealer of
1009 Norjth Florence street was struck
by a street car near Third street Satur-
day and seriously injured. Taylor was
riding a bicycle and was caught be-
tween the car and an express wagon.
A jury in the Wentzler will contest
decided that all of the estate of the
late Mrs. Willis G. West shall so to
her daughter by a former marriage
setting aside her will in which she left
all to her husband Willis G. West.

PORTALES BAND ORGANIZED:
WELL HAVE- TWENTY PLAYERS
Portales N. M. Dec 5. The Portaleg
band has been organized and com-
menced practice. There are to be 20
instruments and new Instruments of a
high grade have been ordered. Two
nights" a week are to be devoted to
practice.
The Woman's club met with Mrs.
Floyd Stone. Besides the regular pro
gram officers for the following year
were elected with Mrs. . .c. J-.ir.a-
sey as president
J. B. Madden of Anniston Alabama
has been here this week prospecting.
He has done considerable investigat-
ing of land propositions in the west
I and says that we have the best he has
seen. He has backed up his talk by
buying two or three farms and at last
reports was looking for more
S.'E. Ward constructing engineer of
5 the Westinghouse Machine company
arrived several days ago after an ab-
sence of some weeks. Arrangements
are being made to start the irrigation
power plant soon to test some new
machinery recently added to the plant.
This will afford farmers an opportuni-
ty of giving their alfalfa another irri-
gation. L. S. Vance whose former home was
at Mt Orab Ohio has located in Por-
tales and will engage in the real es-
tate business.
SPECIAL AGENTS' WORK
TO BE REORGANIZED
Reorganization of the special agents'
department of the customs service has
been planned and John E. Wilkie chief
or the secret service has been appoint-
ed by secretary McYeagh to effect it.
Customs collector Alfred L. Sharpe
discussing the plan said: "It is the
intention of secretary McVeigh to place
the customs department on a strictly
business basis. The recent showing in
New York indicated that men of merit
must be secured and therefore civil
service will be applied whereas in the
past It has been the custom to appoint
man- of the attaches from friends of
the senators simply on their "recom--mendation.
'
"It is my understanding that tho
president will recommend ' the appoint-
ment of customs collectors on the civil
service basis and thereby eliminate
politics.
"It is understood that in the reor-
ganization of the customs police Wil-
kie will be assisted by Leslie Cullom
of Baltimore Md. who was at one time
stationed in El Paso before Mr. Parker
came here as special agent."

ACTED UNDER SPELL
Peculiar Claims Made in Ap-
peal for iSTew Trial for
Bat Harriss.
Roswell N. 31. Dec. 5. A motion
has been filed in the district court
asking for a new trial for Bat Harriss
the seventeen year old negro boy who
was convicted here last week on
change of venue from Eddy county on
the charge of murdering Clabe Mer-
chant a wealthy and Influential ranch-
man with an ax. The verdict was sec-
ond degree murder and at the discre-
tion of the court the sentence that will
be imposed can range from three to 39
years in the penitentiary. The neg"o
has been a lifelong employe of "William
E. Washington the ranchman who is
known over the entire west and it la
said is being assisted financially in hig
legal fight by Washington. The mo-
tion was filed by two of the prisoner's
attorneys W. C. Reid and James M.
Hervey both exattorney generals of
New Mexico.
1'wo of the jurors N. S. West of
Hagerman and H. B. Davis of Roswell
make the sworn statement that they
were not capable of wise deliberations
as they had been sick and were influ-
enced in the jury room by their
stronger brothers. Further it is claim-
ed that district attorney Louis O. Ful-
len who is said to be one of the
strongest prosecutors in the country
wielded almost hypnotic influence upon
the minds of the jurors in his speech
in the presentation of the fact that the
counsel for the defence had refused to
put Washington on the stand. Juror
West it is said makes the astounding
sworn statement that he believed th9
defendant "not guilty" and while he
voted "guilty" In the jury room he be-
lieves that he is not and that his de-
cision was not reached while in a con-
scious state of mind.
The Merchant family and its connec-
nections In this section is large influ-
ential and wealthy and deceased was a
nephew of Col. Clabe Merchant sr. a
millionaire stockman of Abilene Tex.
"Bill" Washington on the other hand
Is one of the wealthiest and best known
ranchmen in the United States.

who was awarded the contract for
contract for building the BIsbee-Doug-las
branch of the territorial highway
has arrived here with a gang of la-
borers and an outfit of machinery.
Work will be started during this week
through Forest canyon.
Since the death from diphtheria of
the Whalley girl in Tombstone can-
yon a careful examination of the chil-
dren in the school of that district was
made by Dr. Williams who found
health conditions excellent Examina-
tions however will be continued
periodically for several weeks.
Dr. F. E. Shine gave an. address on
"The Prevention of Contagion" before
the Mothers' meeting held in Warren.
. George F. Kilmer a veteran of the
civil war and a iy5neer of Cocllise
county died at the county hospital. His
remains were interred in the Tomb-
stone cemetery.
Mystery surrounds the origin of the
fire which destroyed the two story res-
idence owned by R. M. Richards in
upper Tombstone canyon. The house
was Insured for $1000.
BRAKEMAN FALLS FRQM CAR

Fort Sumner N. M. Dec 5. Law-
rance Martin a brakelnan fell from the
top of a Santa Fe freight train near
here. He was passing signals from
the rear and stepped to the side of tire
car catching his foot on a nail and
pitching over. He was not found until
the next morning and was seriously in-
jured. Holiness people from the college at
LaLande are here building a church
on the highest ground down town. A
movement is on foot to unite the Elida
and LaLande branches of the Holiness
society and to establish the united
force at LaLande. It is said that pres-
ident Beeson intends to relinquish the
head of the association and return east
The outlook for the development of
ar tesiarr water at Byrfed by govern-
ment help continues bright The pres-
ent indications are that about $30000
will be appropriated.
The Harris-Hunter case over the ac-
counting of the partnership business
that A. B. Harris and John Hunter
conducted here has been on for several
days before a referee. The case has
been dragging for weeks owing to the
amount of testimony taken.
The Santa Fe announces that during
this year July was the only month
that did not snow a substantial in
crease in business at this station over I
the corresponding month a year ago.
Some months have shown double the
old volume. It is also said that thia
is the only town on the cutoff that is
i not running behind Its last year's busl-
j ness
The Santa Fe's pathfinder J. P. Stew-
art has driven overland to Las Vegas.
When he arrives there he will chain
back to this point in the hope that the
line to this place will show up better In
rades than that from Las Vegas to
i Vaughn. The Santa Fe by building to
this place would tap the Colfax coal
deposits for use on the San Francisco-
Galveston line.
Surveyors have completed the work
of cutting up more land into ten acre
tracts and getting ready for the seven
! miles of new ditch to be built from
the lower end of the present canal.
ORCHARD AT YSLETA IS
DAMAGED BY GRASS FIRE
Ysleta Tex Dec. 5. While the sec-
tion hands were burning brush along
the railroad rightofway the fire got
into the grass of the Payne-Hienemau
orchard and burned the grass beneath
the trees. The injury to the trees
cannot be estimated.
Numerous parties came down from
El Paso in automobiles Sunday and
gathered mistletoe for Christmas dec-
orations. The social and dance given at La
Luna ranch Saturday evening was a
splendid success. A large number of
people from El Paso and the valley at-

for "the Teachers" institute to be held
in the nigh school building in this
city December 19 to 23 inclusive has
been announced by T. Y. Leavell.

As a result of the city taking over the
water plant the old board of directors
comprising some -men interested in
Phelps-Dodge property will resign and
the directorate will be filled (with city
officials. The contract of sale specifies
that the incorporation of the water plant
shall be maintained. The retiring direct-
ors are H. J. Simmon3 Walter Douglas
C. E. Mils. L. D. Ricketts Frank
Powers and W. V. Turney. "W. H.
Burges was formerly a director but re-
signed. '
A meeting was scheduled for Mondav
night but it is not certain that it will
be held.
The new governing board will even-
tually be composed of mavor Kelly
aldermen McGhee Blumenthal Hewitt
and Clayton city attorney Coldwell and
W. E. Race superintendent of the plant.
CITY TAX ROLL IS
NEARLY COMPLETED
Compilation of the total of the un-
rendered tax roll will be completed Mon-
day afternoon according to the expec-
tations of city assessor Behr and city
clerk Fassett. The unrendered and ren-
dered valuations are expected to give
the citya valuation for assessment of
$31000000. On this basis the tax rate
for the mayor's budget for the coming
year will be determined.

in advance of the city's valuation. On
this principle all that remains to be
determined is the amount of the city tax
rate to make up the monev for this
budget.
CARPIO DIES FROM

As the result of injuries received
Wednesday by his own revolver while
attempting an arrest at Socorro con-
stable C. C. Carpio died Sunday in an
El Paso hospitaL Carpio was shot
through the abdomen while scuffling
with a drunken man. The body ha
been sent to his home in Socorro.

died Sunday In Highland Park. The
body has been shipped to Brush Colo.

CRAMPED FOR SPACE
Working under difficulties the dis-
tribution of mail at the postoffice con-
tinues with seven clerks in the privato
office of postmaster Smith. It is ex-
pected that the floor of the new maz-
zanine gallery will be laid within two
weeks and the force -will be ready for
the Christmas rush.

RUSH IS ON TO NEW
COCHISE OIL FIELD
Bisbee. Ariz.. Dec. 5. Reports from
northern Cochise county state that
there is a rush to the oil fields there.
There Is much excitement in the dis-
trict and companies are being formed
to take hold of and develop oil prop-
erty. C. Turner had gone to El Paso
to interest El Paso people in an oil
proposition near Bowie.
FLOATING THEATER' WILL
MAKE TOUR OF WORLD.
New York N. Y. Dec. 5. Kyle Bel-
lew and a company of 50 will start
from London on August 15 next for a
47000 mile tour of the world in a
chartered steamship so Charles Froh-
man announces. A "London syndicate
I and Mr! Frohman will finance the am
bitious theatrical innovation which It
is estimated wilj require two and one-
half years to complete.
The vessel will be fitted with" a the-
ater and both dramas and musical com-
edy will be produced either on board
or where stops are of sufficient dura-
tion at inland points. It is proposed
to visit every port where there is an
English settlement including some
where a professional company has nev-
er appeared.
CHARGE SUPERINTENDENT'S
HORSE DAMAGED PROPERTY
X. R. Crozier. superintendent of the El
Paso public schools was notified Mon-
Lday morning to appear at the police
station and answer to a charge o
destro3"ing public property. In the com-
plaint it is alleged that "a horse driveis
by Mr. Crozier seriously damaged a tree
in front of Franklin school. Mr. Crozier
has promised to replace the tree.
WELLS FARGO TO MOVE
INTO BASSETT BUILDING
After January 1 the Wells Fargo ex-
press company will be located in the
Bassett building on Mills street. The
room on San Antonio street formerlv
the Wells Fargo building has been sold
and fne company is moving to the Mills
street room to get out of the high rent
district.
ELKS TO SMOKE.
The Elks iviil have their monthly
smoker Tuesday evening after the regu-
