practically every civil action that
comes before a trial court origi-
nates in an honest difference of
opinion as to what the law or the
facts of that case are.
But right cannot be on both
iides; so one or the other of the
litigants must be mistaken. When
you seek legal counsel on such a
question, it frequently happens

The law is clear
enough so that among the millions

are appealed
In Texas, cases
from a District court to one of
eleven Courts of Civil Appeals.
Sometimes the judgment of the
latter court is final, as in ordin-
ary divorce cases not involving
property. But if the case meets
certain requirements it may be ap-

Criminal cases are appealedlv
Texas. Criminal cases are appeal-
ed directly from the District court
to the Court of Criminal Appeals,
which is the highest state court in
criminal matters.
Federal cases are appealed from
a U. S. District court to a Circuit
Court of Appeals and from there
to the Supreme Court of the Unit-
ed States, provided the latter will
assume jurisdiction of the matter.
When you appeal your case, you
ask that the error you believe you
have found be corrected. If it
was an error, that is what will
happen—the trial judge’s decision
will be reversed.
Sometimes the courts are com-
pelled to decide a question one
way because the law says so, but
the results bring to light serious
defects on the existing law. When
such an injustice is discovered, the
legislature may remedy the defect
by passing laws to correct it.
