Famous Court
Case Recalled
By Petition
Among prisoners being
transferred to the state peni-
tentiary at Huntsville last week
by special bus from Wichita
Falls was Huron Ted Walters,
about 60, who served time in
Alcatraz Federal Prison and
other penitentiaries.
Walters, a member of the
notorious Floyd Hamilton gang
of the 1930’s, was involved
with Hamilton in the burglary
of the Ringgold drug store, own-
ed and operated by the late Wi-
ley Gilmore.
The two practically cleaned
the shelves of the drug store,
says Atty. Earl Fitts, loading
the loot into a pickup they had
taken from Paul Donald in Bo-
wie. Many of the items, includ-
ing labelled drugs, were found
in the Trinity River in Fort
Worth. The safe was taken from
the store, dumped in a pasture
east of Ringgold and rifled of
its contents. Papers were scat-
tered all around the scene when
the safe was discovered the next
morning.
Found hiding out in Dallas
after a tip to County Sheriff
Dick Lawrence, the two were
tried in Montague. Atty. Earl
Fitts was appointed by the court
to defend the two. Having been
convicted twice before, Ted
Walters was given anautomatic
life sentence under the habit-
ual criminal act by the jury
with the late Rex McDaniel,
jury foreman.
It has been reported that
later, while on parole, Wal-
ters committed murder.
Hamilton drew a five-year
sentence and was remanded to
Texarkana for trial on a bank
robbery charge. Both were sent
to Alcatraz. Apparently re-
formed, Hamilton has been re-
leased and has made appeatr-
ances in behalf of the state’s
efforts to keepyouths from lives
of crime.
Walters was in Wichita Falls
to appeaj his sentence, seek-
ing release on grounds that
his constitutional rights had
been violated. Recent rulings
by the U. S. Supreme Court
were used in the appeal which
was denied by Judge Sarah T.
Hughes.
