loss of revenue that would be
created by the exemption,” Milner
said. “What should be of greater
concern, however, is the long-term
economic impact such actions will
have on a community. An area’s tax
structure will significantly affect
employers decisions on relocation or
expansion sites. Negating the
freeport exemption sends a strong
signal fo companies about the
business philosophy of a
community.”
The Chamber points out that a
goods-in-transit exemption existed
in Texas for many years until a 1985
Texas Supreme Court decision ruled
there was no provision for the
abatement in the Texas
Constitution. For that reason, most
communities should view tax
revenue of the past four years a
windfall that would otherwise never
have been realized.
Since 1985, Texas has been the
only state in the nation not providing
some sort of exemption for goods
which are temporarily in-state for
the sole purpose of manufacture and
distribution out of state, placing
Texas promoters at a disadvantage
with neighboring states
Milner said the Texas Chamber is
asking policymakers across Texas
to carefully weigh the long-term
economic benefits against a
potential short-term loss of revenue.
“An exemption for ad valorem
taxation for goods temporarily in the
state is a powerful economic
development tool which currently
works well in 49 other states,”
Milner said. “In Texas, the decision
is now up to local officials as to how

an exemption within their
jurisdiction. We are urging those
officials to give the exemption
