Dear Sir:
Enclosed herewith is an
opinion from the Attorney-Gen
eral with reference to the law
passed by the 35th, Legislature
extending the time until Janu-
ary 31st, 1918, for the filing of
suits, for the collection of J917
tax only.
You will observe from this
opinion that it in no wise affects
the duty of the Tax Collector
in the collection of delinquent
taxes of other years, and you
are authorized and instructed to
proceed in the usual way after
the first day of February to
force the collection of the 1917
delinquent tax on all personal
property owned by the delin-
quent tax payer.
Use . every effort possible to
collect all the delinquent tajr
that you can by the 31st, of
March in order to be ready to
close'your annual settlement for
the year and make your report
to this department on time.
I hope that you will^ give the
opinion your immediate atten-
tion and explain to the tax
payers at once that - the
only thing the tax payer
can gain by allowing his tax to
become delinquent, will he that
the County Attorney cannot
file suit against his real estate
until after January 81st., 1919.
All costs, penalty and inter-
est will accrue against his prop-
erty, and it will be the Tax Col-
lector's duty to foreclose on his
personal property and collect
bis tax.
If you will explain this opin-
ion thoroughly to your tax
payer j, I think you will prevent
a great many tax; payers from
going delinquent the first day
