July 14, 1961 The Honorable Truett Latimer House of Representatives Capitol Station Austin, Texas Dear Mr. Latimer: During the regular session of our Legislature I took the liberty of writing to you during the month of April regarding the possibility that a needed sales tax bill might be enacted. You very considerately replied and I thank you, Sir. The present State of Texas tax on cements of $0.0275 per hundred pounds, deemed to be applicable upon the first sale and/or use of same within our state, is in fact a "sales tax." The Senate version of H.B. 334 during the past regular session of our Legislature contained an exemption clause, Art. 20.04 Exemptions (B), which we trust will in effect be logically included in the present special session H.B. 20 or any other sales tax legislation enacted so as to prevent double sales tax on the sale of cement in our state.
