in his court — were a matter of
public record.
A memorandum on the State
of Texas versus the 47-year-old
Anglo who was reportedly as-
saulted, signed by Burdett, stat-
ed that the defendant “was ar-
rested by Charles Moore of the
Texas Highway Patrol and pla-
ced in the Drunk Tank in the
Deaf Smith County Jail in the
Deaf Smith County Courthouse
in Hereford, Texas, pending the
filing charges for driving while
intoxicated and (the defendant)
was also charged in Justice of
the Peace Court with speeding.
(The defendant) this morning,
told me that he had taken a
blood teet but at this time did
not know the results of the blood
test.
“I was informed by Officer
Glen Toles of the Highway Pa-
trol Department and by (the de-
fendant) that after (he) had
been placed in the Drunk Tank
Friday night (date) two other
individuals (so named) were
placed in the Drunk Tank with
(him). Not long after these two
individuals were placed in this
tank with (the defendant) they
attempted to get (him) to com-
mit acts of sodomy with them
and he resisted. Upon his re-
sistance both of the two named
individuals hit him about the
" face and about the body, bad-
ly bruising his eyes, and they
also kicked him with their feet
physically injuring him.
"(His) hearing aid was broken
or destroyed, and his glasses al-
so were broken. (He) was dis-
covered in this condition by of-
ficers of the Sheriff’s Depart-
ment and taken to Deaf Smith
County Hospital. I believe this
is where he was taken, or he

re they voted to pay slightly
more than 8500 to the man dis-
missed on DWI charges for his
damages to a hearing aid and
glasses. When the story involv-
ing Judge Williams' statements
to the Amarillo reporter appear-
ed the following day and was
brought to the attenton of the
Brand the Brand tried several
times to contact the judge for
comment However, the judge
was not available Highway pa-
trolmen contacted wculd offer
no statement — as was the case
with the Amarillo reporter. The
Brand delayed its press time in
attempts to contact the judge.

No representative of the High-
way Patrol or the Sheriff’s Of-
fice appeared before Commis-
sioners Court during the discus-
sion.
The commissioners agreed to
study the situation and take all
steps necessary to solve the po-
blem. Burdett pointed out the
rights of a County Judge and
indicated that Judge Williams
did have the power to request
the presence of the arresting of-
ficer to appear in court on their
own complaints, by issuing an
order. The judge stipulated that
he realized his powers in the o-
peration of the court and had
not made any statements that he
couldn't back up.
In other matters, the insur-
ance on kitchen equipment at
the Deaf Smith County Bull
Barn was increased from 85,000
to 810,M0.

reported that he now had five
Citizens Band two-way radio un-
its in Precinct 1. “It sure does
help," Coleman said, recalling
that in the past it might
take half a day to get a report
on broken equipment when now
it can be relayed instantly and
repairs begun so much sooner
He said that the base for the C-
B transmitters was in the barn
in the center of his precinct and
that he also had a unit in his
pickup truck
August fire report from City
Manager Dudley Bayne indi-
cated that there were seven
county fire calls (one a false a-
larm) last month and a total of
10 calls within the city.
Precinct 2 and Precinct 4 de-
cided on the bids for the 12-F
Caterpillar maintainers. With
trade-in, the difference totaled
821.384 in Precinct 4 and 821,

1M8, Judge H. C. Williams, the
undersigned (Burdett), Mr.
Glen Toles and (the defendant)
and the judge's secretary, Mrs.
(Jay) Spain, had a conference
in the judge's office, at which
the judge informed (the de-
fendant) that on the State's mo-
tion and joined tbereui by the
County Judge, the charges a-
gainst (the defendant) were be-
ing dismissed and that he (the
defendant) was to bring the bills
for the repair of his hearing aid
and for replacing his glasses to
the County Judge and (the de-
fendant) was further informed
that the County would bear the
cost and expense of repairing
these two items
“It was the Couaiy Judge’s
opiates that (the defendant’s)
health was undaly endangered
and it was further the Court's
opiaten that the defendant had
already paid his penalty for aay
criminal act which he might
have been guilty «f.”
The memorandum ended with
Burdett's move to dismiss the
DWI charge.
Judge Williams stated before
the commissioners and Burdett
that due to no clear reporting
by the Brand on the subject of
why cases were dismissed in
his court, it was often great-
ly misunderstood by the public
He stated that there was always
a good reason for any dismis-
sal.
Burdett reported an incident
concerning another case now
before the court, wherein a de-
fendant is charged with theft
of a battery charger The de-

judge and commissioners on the
second floor of the courthouse
and the sheriff's department
and highway patrolmen on the
first floor. Burdett related in-
stances where such disagree-
ments appeared to be true.
Burdett opened Ms statement
to the commissioners by men-
tioning the "treatment" given
the story by the Amarillo news-
paper and its appearance in
the Sunday Brand one day la-
ter.
Later, Judge Williams was
questioned by the Brand about
the story which had appeared
first in the Aman Ik) paper and
said that the Amarillo reporter
had come to his office But he
said that he did not know who
had called the reporter earlier
to inform Mm of a possible
story here. When questioned a-
bout the statements which ap-
peared in the published story
attributed to him, be answer
ed that he had only glanced over
it but to the best of Ms know-
ledge they were correct.
The story reported that Judge
Williams “was ired by criti-
cism which he says was leveled
at him by Highway Patrolman
Charles Moore of Hereford,
defended Friday his dismissal
of a DWI charge against a man
assaulted in the county jail Aug.

The judge pointed out to the
Brand that the sheriff had ac-
tually been the first law enforce-
ment officer who had issued a
verbal complaint toward him on
the matter of the case dismis-
sal He made the statement to
the commissioners that it ap-
