"(a) It is hereby declared to be
the policy of this State that the
open saloon shall not be re-estab-
lished. The sale of spirituous
liquors, manufactured in whole or
in part by means of the process of
distillation and/or liquors com-
pounded and/or composed in part
of such spirituous distilled liquors,
for private profit, is prohibited
within this State except when such
sale is made to the State. The
State of Texas shall' have the ex-
clusiv right to purchase at whole-
sale and to sell at retail such dis-
stilled spirituous liquors. Such sale
shall be made only in unbroken
packages and no such liquors shall
be consumed on the premises where
sold. The Legislature shall pass
laws to prescribe regulations rela-
tive to the manufacture, sale, trans-
portation, and possession of such
spirituous liquors and relative to

and conditional pardons. With the
advice and consent of the Legisla-
ture, he may grant reprieves, com-
mutations of punishment and par-

shall require it to keep record of
its actions and the reasons there-
for, and shall have authority to
enact parole laws.”
Sec. 2. The foregoing constitu-
tional amendment shall be sub-'
mitted to the electors of this State
who are qualified to vote on pro-
posed constitutional amendments at
the general election to be held on
the first Tuesday after the first
i Monday in November, A. D. 1936,
at which election each ballot shall
have printed thereon the words:
“For the amendment of Section
11 of Article IV of the Constitu-
tion of the State of Texas, so as to
provide for a Board of Pardons and
Paroles, and to make the Gover-
nor’s pardoning power subject to
recommendation of said Board, ex-
cept in cases of treason the'Gover-
nor may grant reprieves, commuta-
tions and pardons with the advice
and consent of the Legislature.
“Against the amendment of Sec-
tion 11 of Article IV of the Con-
stitution of the State of Texas, so
as to provide for a Board of Par-
dons and Paroles, and to make the
Governor’s pardoning power sub-
ject to recommendation of said
Boad, except in cases of treason
the Governor may grant reprieves,
commutations and pardons with the
advice and consent of the Legis-
lature.”
Each voter shall strike out with
pen or pencil the clause which does
not indicate his desire regarding
the above proposed amendment.
Sec. 3. The Governor is hereby
directed to issue the necessary
proclamation for said election, and
to have the above proposed amend-
ment published in the manner and
for the time required by the Con-
stitution and laws of this State.
Sec. 4. The sum of Five Thou-
sand ($5,000) Dollars, or so much
thereof as may be necessary, is

funds in the Treasury, not other-
