1 AN ACT
2 relating to the protection and care of individuals with mental
3 retardation and to certain legal protections for individuals with
4 disabilities; providing criminal penalties.
5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
6 SECTION 1. Article 38.072, Code of Criminal Procedure, is
7 amended to read as follows:
8 Art. 38.072. HEARSAY STATEMENT OF CERTAIN [G-I-] ABUSE
9 VICTIMS [VICTI]
10 Sec. i. This article applies to a proceeding in the
11 prosecution of an offense under any of the following provisions of
12 the Penal Code, if committed against a child 12 years of age or
13 younger or a person with a disability:
14 (1) Chapter .21 (Sexual Offenses) or 22 (Assaultive
15 Offenses);16 (2) Section 25.02 (Prohibited Sexual Conduct); or
17 " (3) Section 43.25 (Sexual Performance by a Child).
18 Sec. 2. (a) This article applies only to statements that
19 describe the alleged offense that:
20 (1) were made by the child or person with a disability
21 against whom the offense was allegedly committed; and
22 (2) were made to the first person, 18 years of age or
23 older, other than the defendant, to whom the child or person with a
24 disability made a statement about the offense.1
